THE IMPLEMENTATION OF ILS<br />

Employers may also propose the exempti<strong>on</strong> of certain branches, types of enterprises or<br />

categories of workers, if the implementati<strong>on</strong> of certain standards would cause serious<br />

problems (see Chapter III).<br />

In preparing their positi<strong>on</strong> and proposals, employers at nati<strong>on</strong>al level have to try to<br />

anticipate the impact of the proposed implementati<strong>on</strong> <strong>on</strong> the operati<strong>on</strong>s and the competitiveness<br />

of their member enterprises. For this, an analysis of the particular ec<strong>on</strong>omic<br />

situati<strong>on</strong> and needs of member enterprises is of primary relevance. Additi<strong>on</strong>al<br />

orientati<strong>on</strong> <strong>on</strong> the likely effect of implementing a C<strong>on</strong>venti<strong>on</strong> may be obtained from<br />

employers in other countries who have already gained experience in this regard. Finally,<br />

statements made by employer representatives in the elaborati<strong>on</strong> and supervisi<strong>on</strong><br />

of the C<strong>on</strong>venti<strong>on</strong> in questi<strong>on</strong> could give further guidance.<br />

Implementati<strong>on</strong> of <strong>ILO</strong> C<strong>on</strong>venti<strong>on</strong>s and Recommendati<strong>on</strong>s<br />

Government acti<strong>on</strong><br />

Submissi<strong>on</strong> of newly adopted ILS to the<br />

competent nati<strong>on</strong>al authorities within<br />

12 (18) m<strong>on</strong>ths after the close of the ILC;<br />

governments should inform and c<strong>on</strong>sult<br />

with employers’ and workers’ organizati<strong>on</strong>s<br />

<strong>on</strong> proposals to be made in<br />

c<strong>on</strong>necti<strong>on</strong> with the submissi<strong>on</strong>.<br />

Ratificati<strong>on</strong> of a C<strong>on</strong>venti<strong>on</strong> by a government;<br />

government involves employers<br />

and workers in the implementati<strong>on</strong><br />

process, as stipulated by the C<strong>on</strong>venti<strong>on</strong><br />

in questi<strong>on</strong> or by other <strong>ILO</strong> rules.<br />

N<strong>on</strong>-ratificati<strong>on</strong> or n<strong>on</strong>-implementati<strong>on</strong><br />

of a new C<strong>on</strong>venti<strong>on</strong> or Recommendati<strong>on</strong>;<br />

governments should c<strong>on</strong>sult employers’<br />

and workers’ organizati<strong>on</strong>s <strong>on</strong><br />

re-examinati<strong>on</strong> at appropriate intervals.<br />

Employer involvement/acti<strong>on</strong><br />

Employers remind their government<br />

of submissi<strong>on</strong>, if necessary;<br />

they present their views and proposals<br />

<strong>on</strong> any government suggesti<strong>on</strong>s<br />

made in c<strong>on</strong>necti<strong>on</strong> with<br />

the submissi<strong>on</strong>.<br />

Employers are informed of ratificati<strong>on</strong>;<br />

they engage in the implementati<strong>on</strong><br />

process (collective bargaining;<br />

c<strong>on</strong>sultati<strong>on</strong> <strong>on</strong> ways<br />

and means of implementati<strong>on</strong>).<br />

Employers are informed of the decisi<strong>on</strong><br />

not to ratify or implement a<br />

new C<strong>on</strong>venti<strong>on</strong>; they engage in<br />

re-examinati<strong>on</strong>s and present their<br />

views and proposals.<br />

As stated before, Recommendati<strong>on</strong>s, by their nature, cannot be ratified. Apart<br />

from that, what has been said above about the role of employers in the implementati<strong>on</strong><br />

of C<strong>on</strong>venti<strong>on</strong>s applies equally to Recommendati<strong>on</strong>s.<br />

N<strong>on</strong>-ratificati<strong>on</strong> of C<strong>on</strong>venti<strong>on</strong>s<br />

Although the main feature of C<strong>on</strong>venti<strong>on</strong>s as distinct from Recommendati<strong>on</strong>s<br />

is that they can be ratified, there is no obligati<strong>on</strong> for member States to take this step<br />

(art. 19, para. 5 (e), <strong>ILO</strong> C<strong>on</strong>stituti<strong>on</strong>): “If the Member does not obtain the c<strong>on</strong>sent of<br />

the authority or authorities within whose competence the matter lies, no further obligati<strong>on</strong><br />

shall rest up<strong>on</strong> the Member …”.<br />
