Draft of Annual Tax Bill 2013 published<br />
Early in March <strong>2012</strong> the Federal Finance Ministry has<br />
published the draft of an Annual Tax Bill 2013 dealing<br />
with a number of amendments which the tax administration<br />
sees necessary as a result of recent developments<br />
and in EU jurisdiction and EU law, especially implementing<br />
Council Directive 2011/16/EU on administrative<br />
cooperation in the area of taxation and repealing Directive<br />
77/799/EEC (Mutual Assistance Directive) into<br />
German law. This means that the exchange of information<br />
on transfer pricing and information on foreign<br />
entities would improve. Also, tax neutral business<br />
spin-offs are to fall within the scope of the German flat<br />
rate withholding. Apart from various other changes on<br />
the private use of electrically powered vehicles and the<br />
introduction of a flat rate wage tax of two per cent on<br />
minor employments the draft deals in some detail with<br />
amendments to the Foreign Tax Act (FTA) and on VAT.<br />
In Section 1 of the FTA the allocation of profits to<br />
permanent establishments will specifically be included.<br />
Therefore, the OECD-model standards will apply to all<br />
types of cross-border transactions involving legally independent<br />
permanent establishments. Transfer pricing<br />
rules under the perspective of Section 1 FTA would also<br />
apply to cross-border transactions of active partnerships.<br />
The amendments in the VAT Act give some clarification<br />
on the place of supply of services: Currently, services<br />
provided to those legal entities performing both nonbusiness<br />
and business related outputs and which are<br />
specifically used for non-business purposes are subject to<br />
VAT at the place where the entrepreneur rendering the<br />
services has his registered seat or permanent establishment.<br />
In the future – as a measure of simplifying the<br />
conundrum whether input services are used for business<br />
or non-business – such services are generally subject to<br />
VAT at the place of the customer, i.e. where the recipient<br />
of the service has its registered seat. From 2013 the longterm<br />
car hire to non-businesses is to be taxed at the place<br />
of the lessee. Entrepreneurs living in Germany will in<br />
future be viewed as being resident abroad for matters of<br />
VAT if they pursue business activities from there, if they<br />
have seat, management or a permanent establishment<br />
abroad. Invoicing is subject to the tax requirements of<br />
the country where the service is provided. Clarification is<br />
given that deduction of input VAT on intra-community<br />
supplies is restricted to cases where the supply is made in<br />
Germany. The long-term rental of sporting boats will be<br />
taxable in the country where the boats are put at the<br />
disposal of the hirer. (At present, such transaction is<br />
subject to VAT in the country where the supplier of the<br />
service has his seat or permanent establishment, as the<br />

für Besteuerungszwecke verbindlich für alle 26 Mitgliedstaaten<br />

zukünftig verpflichtet, auf Ersuchen alle für ein Besteuerungsoder<br />
Steuerstrafverfahren erforderlichen Informationen zu erteilen.<br />
Davon ausgeschlossen sind reine Beweisausforschungen.<br />
Dividendenzahlungen. Die Regelungen zur Vermeidung<br />
einer Doppelbesteuerung von Dividendenzahlungen und anderen<br />
Gewinnausschüttungen von Tochtergesellschaften an ihrer<br />
Muttergesellschaft werden via Referentenentwurf der Neufassung<br />
der EU-Richtlinie über das gemeinsame Steuersystem<br />
der Mutter- und Tochtergesellschaften verschiedener Mitgliedstaaten<br />
