4. Two-thirds of those present shall concur, to find<br />

the accused guilty of any specification.<br />

5. <strong>The</strong> punishment shall be fixed by a like vote, a<br />

majority determining its nature and extent.<br />

6. <strong>The</strong> accu~cd shall then be called in, and informed<br />

of the result. If he be found guilly, the sentence shall<br />

be communicated by the Chancellor, to all i’dasonic<br />

bodies of which he is a member, and the punishment<br />

shall be imposed according to the sentence, and the<br />

laws, statutes and regulations governing the case.<br />

7. If the trial proceeds in the absence of the accused,<br />

the DefeDder shall represent him, and perform all the<br />

duties of Council for him to the best of his ability.<br />

ARTICLE V.<br />

1. Appeals from judgment of Chapters of Rose<br />

Croix, shall be sent up in writing, with all the papers,<br />

a simpL=notice of appeal being alone necessary to give<br />

the Tribunal jurisdiction.<br />

2. Every appeal shall be suspensive.<br />

3. If the appeal be on the facts, the Tribunal shall<br />

try it de novo. If it involve only a question of law,<br />

they shall decide it, and ~ffirm, reverse, demand or grant<br />

a new trial, or altogether quash and annul, as may be<br />

proper and in accordance with <strong>Masonic</strong> law.<br />

4. In case the Tribunal tries the case de novo, the<br />

proceedings at the trial shall be the same as in cases of<br />

original jurisdiction.<br />

5. Any Subordinate body may submit a question or<br />

questions to the Tribunal for its decision, upon order to<br />

that effect, and the Tribunal shall take jurisdiction, upon<br />

a certificate of the Recorder or Secretary of such<br />

inferior body, stating the question and its reference,<br />

shall decide, and transmit a certificate of’ its decision,<br />

and upon the decision of such questions, that of the ma-<br />

jority shall stand as the decision of the whole, aiid no<br />

dissent be niade known; but any Commander who dissents<br />

may present his opinion in writing, with the reasons<br />

for it, and have it filed for reference.<br />

6. A record of all such decisions, and of the decisions<br />

on points of <strong>Masonic</strong> law, shall be kept by the Cliancelbr<br />

in a book for that purpose, under appropriate headings.<br />

ARTICLE VI.<br />

1. No trial whatever for offences shall be had in any<br />

corisistory of Sublime Princes of the Ro 3 al Secret.<br />

2. <strong>The</strong> Tribunals of the 31st degree shall also have<br />

a jurisdiction to issue mandates, to require Subordinate<br />

bodic~ to proceed to judgment or other’vise, to do whate~er<br />

acts they ought to do in order to give to a brother<br />

his <strong>Masonic</strong> rights, as also mandates requiring them to<br />

desist from proceeding in proper cases, and mandates to<br />

bring up their proceedings, x~hen alleged to be against<br />

law, to be examined and affir.med, or quashed, as law<br />

and right may require.<br />

6. <strong>The</strong>y shall also have jurisdiction to issue mandates,<br />

to bring before them questions of right to office<br />

in Subordinate lodges and bodies, and to hear and determine<br />

the same.<br />

]. And mandates to suspend, or supersede any judgiimcnt<br />

or action of such inferior body.<br />

5. <strong>The</strong> said Tribunal shall usurp and assume to<br />

themselves no powers not granted by these statutes, or<br />

not following as necessary incidents or corollaries from<br />

the powers hereby granted.<br />

6. <strong>The</strong>y may act as Tribunals of conciliation or decision,<br />

in all matters of difference, dispute or dissension
