If the decision of the departmental or unit tenured faculty and that of the dean of the academic<br />
unit are not the same, the Provost may, if he/she chooses, submit the matter to the URTP&S<br />
Committee for review and recommendation. In this event, the faculty person shall have the right<br />
to review all the documentation pertinent to the decision regarding his/her status, including proof<br />
of uniformity in the application of the standards for tenure. If the Provost follows this procedure,<br />
he/she will upon receipt of the recommendation of the URTP&S Committee, forward the<br />
URTP&S Committee’s recommendation to the President. If the URTP&S Committee upholds<br />
the denial of a request for tenure, it shall provide the faculty member with a detailed written<br />
articulation for the basis of the denial.<br />
If the decision of the Provost is unfavorable to the faculty member, whether it supports or rejects<br />
the unit recommendation, said faculty member shall have the right to appeal such decision to the<br />
URTP&S Committee. The findings and recommendations of the URTP&S Committee shall be<br />
submitted to the President along with the recommendation of the Provost.<br />
The faculty person shall have the right to review all documentation pertinent to the decision<br />
regarding his/her status, including proof of uniformity and accuracy in the application of the<br />
standards for tenure.<br />
Upon receipt of the recommendation from the Provost, and where appropriate, the URTP&S<br />
Committee, the President shall make a final administrative decision which shall be reported to<br />
the Board.<br />
4.5 Annual <strong>Faculty</strong> Performance Review<br />
Scope<br />
Annual reviews of performance shall be conducted for all faculties on a calendar year basis.<br />
Performance evaluation of tenured faculty shall be consistent with the basis of procedures set out<br />
in this section and adopted pursuant to <strong>Texas</strong> Education Code, Section 51.942.<br />
Guidelines<br />
The faculty of each academic unit shall prepare in each department written criteria for categories<br />
of performance to be assessed in annual reviews. Besides faculty approval, the respective<br />
department chair and dean shall approve such rules. The department chair shall distribute these<br />
rules to faculty by October 1 of each academic year. The different units may weigh the criteria<br />
listed differently and evaluate faculty differently depending upon the faculty member’s role and<br />
responsibilities in the academic unit.<br />
Outcome<br />
The departmental rating of a faculty member may range from most meritorious to unsatisfactory.<br />
A rating of unsatisfactory performance must be supported by an articulation of the finding based<br />
upon the department’s approved criteria or the criteria listed in this manual. A report to the dean<br />
