SECTION EIGHT<br />
GRIEVANCE PROCEDURES<br />
8.0 Appeal of Denial of Rank, Tenure, Promotion, and Merit Raises.<br />
The appropriate committee of the lowest academic unit for initial resolution shall hear all<br />
disputes over denial of rank, tenure, promotion and merit raises.<br />
A. Denial of Promotion:<br />
If a departmental or school committee, the Dean, or the Provost denies application for<br />
promotion, the faculty member may appeal to the <strong>University</strong> Rank, Tenure,<br />
Promotion and Salary Committee (URTP&S) for reconsideration within thirty days of<br />
the date of the Provost’s notification that promotion was denied. The URTP & S<br />
Committee shall have thirty days to complete the hearing. The URTP&S Committee<br />
shall confine its review to the record. The burden of proof shall be borne by the<br />
faculty member. Within ten days of the conclusion of the hearing, the URTP&S<br />
Committee shall in writing advise the Provost of the findings and the<br />
recommendations. Within ten days of receipt of the committee’s findings, the<br />
Provost shall forward the recommendation in writing to the President and to the<br />
faculty member. If the URTP&S Committee determines that promotion should be<br />
awarded, it shall report this to the Provost for appropriate corrective action within ten<br />
days.<br />
B. Tenure Denial<br />
If a department or school committee, the dean or the Provost denies application for<br />
tenure, the faculty member may appeal to the <strong>University</strong> Rank, Tenure, Promotion<br />
and Salary Committee (URTP&S) for reconsideration within thirty days of the date of<br />
first notification that tenure was denied. The URTP & S Committee shall have thirty<br />
days to complete the hearing. The URTP&S Committee shall confine its review to<br />
the record. The burden of proof shall be borne by the faculty member. Within ten<br />
days of the conclusion of the hearing, the URTP&S Committee shall in writing advise<br />
the Provost of the findings and recommendations. Within ten days of receipt of the<br />

President and to the faculty member. If the URTP&S Committee determines that<br />
tenure should have been awarded, it shall report this to the Provost for appropriate<br />

If recommendation for tenure is denied, the Office of the President shall notify the<br />
faculty member no later than May 31st of the next-to-last year of probationary service<br />
that the subsequent academic year will be his or her last year of employment.<br />
