tenure or appointment. The President’s decision and reasons for approval, rejection, or<br />

amendment of the committee's findings and recommendation shall be stated in writing and<br />

communicated to the accused and made within ten (10) days after receipt of the materials from<br />

the hearing committee.<br />

7.10 Request for Board Review of President’s Decision<br />

Upon written request by the faculty member, the Board may review the President’s decision.<br />

The request for review must be received in the Board of Regents’ Office within thirty (30)<br />

calendar days of the faculty member's receipt of the President’s decision. Such request should<br />

specifically identify and discuss any defects in procedure or substance, which require review and<br />

reversal of the President's decision. The President may submit a written response to the request<br />

for review to assist the Board in its deliberations. The Provost shall provide the accused faculty<br />

member with fourteen (14) calendar days notice of the Board’s consideration of the matter.<br />

7.11 Board Review<br />

The Board shall decide by a majority whether to review the President’s decision. If the Board<br />

decides to not review the President’s decision, the President’s decision shall be final. If the<br />

Board decides to review the decision, the hearing committee’s findings and recommendation,<br />

any briefs submitted, and the President’s decision and reasons for approval, rejection, or<br />

amendment of the committee's findings and recommendation shall be delivered to the Board.<br />

The Board shall decide by a majority whether to approve, reject, or amend the President’s<br />

decision or recommit the matter to the hearing committee for additional evidence and<br />

reconsideration of its findings and recommendation. The Board’s decision and its rationale for<br />

the decision shall be stated in writing and communicated to the accused. The Board’s approval,<br />

rejection or amendment of the President’s decision shall be final.<br />

7.12 Alternative Dispute Resolution<br />

A faculty member subject to termination on the basis of a performance evaluation conducted<br />

pursuant to <strong>Texas</strong> Education Code, Section 51.942 shall have the opportunity for referral of the<br />

matter to a nonbinding alternative dispute resolution process as described in Chapter 154 of the<br />

Civil Practice and Remedies Code.<br />

7.13 Extension of Deadlines<br />

Any deadline in this section may be extended upon mutual agreement of the parties. There shall<br />

be no waiver of any provision herein if the deadlines are not met for any reason aside from<br />

neglect.<br />
