Further, the Defence lawyers may have access to detailed evidence affecting the issues which they may not want to reveal to the Prosecution through the Medical Practitioners in advance of any trial.
Comment on paragraph 5.21 final sentence : One Snaresbrook Defendant with a history of mental and physical illness refused to participate in the trial process, refused to take his medication, refused to see a psychiatrist and ended up in the isolation ward at Pentonville suffering from TB. He would not have participated in any test, standardised or otherwise. He had a history of murder ( he decapitated the corpse ), attempted rape and sexual assault.
