Item 26 i<br />

Provided prepalletized cargo complies in all respects with the rules set forth herein the<br />

carriers will allow a discount of 2 50 per ton weight<br />

basis as cargo is being freighted<br />

or measurement on the same<br />

The respondent does not dispute that the cargo was properly palletized<br />

and complied with all the rules set forth in Item 26 The respondent s bill<br />

of lading clearly shows the weight of the 31 pallets to be 63 Ibs each as<br />

does the complainants supporting shipping documents Therefore it is<br />

found that the complainant has furnished the necessary information at the<br />

time of shipment to detennine the weight of the pallets as required by<br />

Items 26t and i and has otherwise met the requirements of Item 26<br />

Hence complainant is entitled to a pallet weight allowance of 1 953 Ibs<br />

63 Ibs x 31 pallets and a rate discount of 2 50 per 2 000 Ibs<br />

Complainant having met his burden of proof reparation is awarded in<br />

the amount of 357 40 the difference betWeen the charges assessed of<br />

1 654 94 and the correct charges of 1297 54 25 772 Ibs at 100 50 per<br />

2 000 Ibs less 2 50 rate discount plus surcharge and packing charge<br />
