EASTBOUND AND WESTBOUND TRADES BElWEEN JAPANESE PORTS AND<br />

PORTS IN CALIFORNIA OREGON AND WASHINGTON<br />

SUPPLEMENTAL ORDER<br />

March 7 <strong>19</strong>77<br />

This is an investigation commenced by <strong>Commission</strong> Order of March 5<br />

<strong>19</strong>76 the purpose of which is to determine whether Agreement No 10116<br />

shall continue in force and effect through December 31 <strong>19</strong>78 The six<br />

lines party to the Agreement werenamed Respondents in the proceeding 1<br />

The Marine Cooks and Stewards Union was named Petitioner The<br />

investigation was limited to the submission of affidavits of fact and<br />

memoranda oflaw unless the <strong>Commission</strong> determined that an evidentiary<br />

hearing was required<br />

Respondents filed an affidavit and a memorandum of law After<br />

resolution of an interlocutory dispute regarding Respondents unsuccessful<br />

attempt to prevent the disclosure of some of the financial data contained<br />

in Respondents affidavit Petitioner fIJed an affidavit and a memorandum<br />

of law and Hearing Counsel fIJed a memorandum of law Respondents<br />

also moved for permission to fIJe a rebuttal to Petitioner s and Hearing<br />

Counsels affidavits Petitioner opposed that motion and Hearing Counsel<br />

supported Respondents None of the parties to the proceeding requested<br />

oral argument<br />

Agreement No 10116 was made in Tokyo Japan on January 30 <strong>19</strong>74<br />

and filed with the <strong>Commission</strong> in Washington the next day By that<br />

Agreement the six Respondents pool the revenue derived by each<br />

Respondent from the carriage of cargo eastbound and westbound between<br />

ports in Japan and ports in the States of California Oregon and<br />

Washington including overland common point cargo<br />

As originally fIJed the Agreement provided for a term of three years<br />

from the date of approval Sea Land Service Inc fIJed comments with<br />

the <strong>Commission</strong> urging the <strong>Commission</strong> to limit the Agreement to aterm<br />
