No State Listed Endangered Species are found within the Study Area. Four bird species, the
olive-sided flycatcher, the blackpoll warbler, the Townsend’s warbler, and the grey-cheeked
thrush—are each listed as an Alaska species of special concern and may be found in the
Study Area. Five state species of concern, however, may be found in the Study Area. These
species include the Cook Inlet beluga whale, the olive-sided flycatcher, the blackpoll
warbler, the Townsend’s warbler, and the grey-cheeked thrush (ADF&G 2005c). These bird
state species of concern are addressed in detail in Sections 3.8.8.3 and 3.8.8.4.
3.8.10 Permits
Development of the KAC Project will require permits, reviews, and consultations by federal,
state, and municipal resource and regulatory agencies. FHWA has relied on the guidance
provided in “Applying the Section 404 Permit Process to Federal-Aid Highway Projects”
(FHWA 1988) for the proposed project. Cooperating agencies (listed in Section 7) have been
consulted throughout the process and will continue to be involved as permit applications are
finalized and submitted.
Draft permit applications and requisite supporting documentation, including a consistent,
comprehensive project description, have been prepared for the Preferred Alternative. As
design details for the proposed KAC project mature, permit applications will be finalized and
submitted to the appropriate agencies.
Federal, state, and local laws authorize agencies to issue permits, review plans, and provide
consultations on possible project impacts. Table 3-34 identifies the statutes, regulations, and
executive orders that govern permits, consultation, coordination, and review requirements
that have been identified as pertinent to the proposed KAC project.
