I – regional characterization of the country
should be defined based on land and port infrastructure
and the potential flow of cargo
and passengers, as well as the guidelines for
regional development established by the Federal
Government;
II – characterization of the demand and supply
of regional port capacity;
III – competitive impact studies that identify, by
region, the distribution of the potential market,
by product type, among the existing terminals;
IV – calculation of indicators of market concentration;
and
V – aspects of technical, environmental and
operational feasibility to determine, by region,
the appropriate areas for the installation of
new organized ports.
According to the Director-General,
the PGO should serve as reference
for the strategic planning of
port activities by the public and for
the investment decisions of key
representatives of the private sector.
Data from the study itself
should mark the regulatory activity
developed by ANTAQ.
On September 18, 2009, the
SEP approved the PGO proposed
by ANTAQ, transiently. The study
will be reviewed by the Agency and
be subject to the approval of the
SEP within fifteen months, in line
with Administrative Rule SEP/PR
178/2009 and in accordance with
the guidelines and policies of Decree
6.620/2008, taking into account
certain topics and premises
(see charts).
The review should consider
the following points:
l The need for additional studies and surveys submitted by
ANTAQ and implemented to meet the guidelines and policies
established by Decree 6620, of October 29, 2008;
l The fact that, for the fulfillment of items I to IV of Article
44 of Decree 620/2008, the mapping and characterization
of port facilities are necessary conditions, as well as the calculation
of the current and maximum capacity installed,
aiming at optimizing the national port structure, required in
that legal instrument;
l The need for further studies affirming the capacity for expansion
of public ports; and
l The projects of public and private terminals being implemented
in the country.
