l <strong>Waterway</strong> <strong>Panorama</strong> Vessel Chartering The regulation of ANTAQ for the chartering of vessel for the provision of existing maritime and support navigation transport services is performed through registration or authorization. Registered chartering occurs for Brazilian flag vessels, foreign vessels, when the provisions of Decree-Law 666/69 for long-haul navigation (which addresses the mandatory transport in Brazilian flag vessels for prescribed cargo) does not apply, or even foreign vessels under bareboat charter, suspended flag, for cabotage, support maritime, according to certain limitations of deadweight tonnage. Authorized chartering occurs in the foreign vessels by time or trip, cabotage or maritime and port support navigations, as well as bareboat in port support navigation, or even long-haul shipping in the case of suspension of the mandatory cargo transport under the Brazilian flag. Chartering is further subdivided by m, namely: bareboat, time, and trip. The latter receives specific names (for control purposes), i.e., by space, for the chartering of part of a vessel for a trip. Through its rules, ANTAQ establishes chartering procedures and criteria to be followed, depending on the type of navigation. The monitoring of boat chartering authorizations/records, as well as the release of transport of cargo under the Brazilian flag in foreign vessels, belonging to foreign shipping companies, allows for the assessment of the level of competitiveness of Brazil in the political/economic scenario of international maritime transportation. Despite the need for chartering, motivated by the lack of Brazilian flag vessels, such expenses allow for the exchange remittance to foreign countries. Balancing the development of a national merchant marine, while attracting foreign investment, albeit through the participation of foreign companies in the capital of Brazilian shipping companies, is the challenge to be faced while regulating the sector. However, for such success, it is essential to establish public policies for the sector to encourage the consolidation of existing regulatory frameworks of waterway transportation.
