The estimated staff hours for the preparation of this report was approximately 28 hours. Statutory and Policy Compliance Implications Agencies, including Councils, must publish open access information in the manner prescribed by the GIPA Act or Regulation unless there is an overriding public interest against disclosure (s 6(1)), or if it would involve an unreasonable cost to the agency (s 6(2)). Section 18 of the GIPA Act outlines the type of information that comprises an agency’s open access information. For local councils, DA information forms part of a council’s open access information pursuant to Schedule 1[3] to the GIPA Regulation. Schedule 1[3] provides as follows: 3(1) Information about development applications (a) development applications (within the meaning of the Environmental Planning and Assessment Act 1979) and any associated documents received in relation to a proposed development including the following: (i) home warranty insurance documents, (ii) construction certificates, (iii) occupation certificates, (iv) structural certification documents, (v) town planner reports, (vi) submissions received on development applications, (vii) heritage consultant reports, (viii) tree inspection consultant reports, (ix) acoustics consultant reports, (x) land contamination consultant reports, (b) records of decisions on development applications (including decisions made on appeal). However, the following information is excluded under schedule 1(3)(2) (a) the plans and specifications for any residential parts of a proposed building, other than plans that merely show its height and external configuration in relation to the site on which it is proposed to be erected; or (b) commercial information, if the information would be likely to prejudice the commercial position of the person who supplied it or to reveal a trade secret. PLANNING – Public Exhibition Report for Amendments to Byron Shire DCP 2010 – Chapter 1 Part F – Waste Minimisation and Management Executive Manager: Environment and Planning Report Author: Wayne Bertram, Manager Development Assessment and Certification File No: #E2013/13882 Theme: Environment and Planning Summary: Council at its Ordinary Meeting held on 10 February 2011 resolved to adopt for public exhibition, the inclusion of a Waste Minimisation and Management draft Chapter in the Shire wide Development Control Plan. (Res11-59). As a result of potential funding losses in the Waste & Sustainability Improvement program, the advertisement of the Waste Minimisation and Management draft Chapter was brought forward for inclusion in the current Shire wide Development Control Plan (2010). The proposed amendments to “Byron Shire Development Control Plan 2010” (DCP 2010) were exhibited for public comment from the 12 March 2013 to 11 April 2013 in accordance with the Environmental Planning and Assessment Regulation 2000. NOTE TO COUNCILLORS: No Submissions were received. It is recommended that Council adopt the amendments to DCP 2010 and notify the public in accordance with the Regulations. 10 In accordance with the provisions of S375A of the Local Government Act 1993, a Division is to be called whenever a motion for a planning decision is put to the meeting, for the purpose of recording voting on planning matters. Pursuant to clause 2(a) under the heading Matters to be Included in Minutes of Council Meetings of Council's adopted Code of Meeting Practice (as amended) a Division will be deemed to have been called by the mover and seconder of all motions relating to this report. 15 RECOMMENDATION: 1. That Council adopt the amendment to Byron Shire Development Control Plan 2010, Chapter 1 Part F - Waste Minimisation and Management, Annexure 4, #E2013/13987. 20 25 30 2. That Council give public notice of its decision to adopt the amendment in accordance with Clause 21 of the Environmental Planning and Assessment Regulation 2000 and that the date it comes into effect is the first available date that the public notice can be published, after the amendments are made. 3. That a copy of the amendment to Byron Shire Development Control Plan 2010 – Chapter 1 Part F - Waste Minimisation and Management, be provided to the Department of Planning to forward to the Director General in accordance with Section 25AB of the Environmental Planning and Assessment Regulation 2000.
