Statutory and Policy Compliance Implications
Regarding the collection of Section 64 charges, Council can impose a condition on development
consents requiring the developer to obtain a certificate of compliance from Council (as the LWU)
for water and/or sewer. This condition can be imposed in accordance with s80A(1)(a) of the EP&A
Act for development of a kind described in clause 224 of the Water Management (General)
Regulation, 2011. Such a condition would require the developer to obtain a certificate of
compliance prior to a relevant milestone for the development.
