hours of four o’clock in the afternoon and seven o’clock in the<br />
forenoon shall be punished by a fine of not more than one thousand<br />
dollars or by imprisonment for not more than four years, or both.<br />
LARCENY; GENERAL PROVISIONS AND PENALTIES<br />

Whoever steals, or with intent to defraud obtains by a false<br />
pretence, or whoever unlawfully, and with intent to steal or<br />
embezzle, converts, or secretes with intent to convert, the<br />
property of another … whether such property is or is not in his<br />
possession at the time of such conversion or secreting, shall be<br />
guilty of larceny, and shall … if the value of the property stolen<br />
exceeds two hundred and fifty dollars, be punished by<br />
imprisonment in the state prison for not more than five years, or<br />
by a fine of not more than twenty-five thousand dollars and<br />
imprisonment in jail for not more than two years; or, if the value of<br />
the property stolen … does not exceed two hundred and fifty<br />
dollars, shall be punished by imprisonment in jail for not more than<br />
one year or by a fine of not more than three hundred dollars.<br />
PERSONAL PROPERTY; MALICIOUS OR WANTON<br />
INJURIES<br />
M.G.L. Chapter 266, Section 127<br />
Whoever destroys or injures the personal property … of another<br />
in any manner or by any means not particularly described or<br />
mentioned in this chapter shall, if such destruction or injury is<br />
willful and malicious, be punished by imprisonment in the state<br />
prison for not more than ten years or by a fine of three thousand<br />
dollars or three times the value of the property so destroyed or<br />
injured, whichever is greater and imprisonment in jail for not more<br />

than two and one-half years; or if such destruction or injury is<br />
wanton, shall be punished by a fine of fifteen hundred dollars or<br />
three times the value of the property so destroyed or injured,<br />
whichever is greater, or by imprisonment for not more than two<br />
and one-half years; if the value of the property so destroyed or<br />
injured is not alleged to exceed two hundred and fifty dollars, the<br />
punishment shall be by a fine of three times the value of the<br />
damage or injury to such property or by imprisonment for not<br />
more than two and one-half months; provided, however, that where<br />
a fine is levied pursuant to the value of the property destroyed or<br />
injured, the court shall, after conviction, conduct an evidentiary<br />
hearing to ascertain the value of the property so destroyed or<br />
injured.The words "personal property'', as used in this section,<br />
shall also include electronically processed or stored data, either<br />
tangible or intangible, and data while in transit.<br />
“DIG SAFE” LAW; EXCAVATIONS, NOTICE, PENALTY<br />
M.G.L. Chapter 82, Section 40 through Section 40E<br />
Section 40.The following words, as used in this section and<br />
sections 40A to 40E, inclusive, shall have the following<br />
meanings:<br />
Company, natural gas pipeline company, petroleum or<br />
petroleum products pipeline company, public utility company,<br />
cable television company, and municipal utility company or<br />
department that supply gas, electricity, telephone,<br />
communication or cable television services or private water<br />
companies within the city or town where such excavation is to<br />
be made.<br />
“Description of excavation location”, such description<br />
shall include the name of the city or town, street, way, or route<br />
number where appropriate, the name of the streets at the<br />
