Pursuant to Section 79C(1)(a)(I) <strong>of</strong> the Environmental Planning and Assessment Act 1979, the proposal does not comply with Clause 76 – Management <strong>of</strong> Stormwater contained within the Warringah Local Environmental Plan 2000. The proposal does not provide On-Site Detention in accordance with Councils “On-Site Stormwater Detention Technical Specification”. 2. Pursuant to Section 79C(1)(a)(i) <strong>of</strong> the Environmental Planning and Assessment Act 1979, the proposal does not comply with Clause 65 – Privacy contained within the Warringah Local Environmental Plan 2000. The proposed dwelling has an elevated terrace/patio that will unreasonably overlook the principle private open spaces <strong>of</strong> neighbouring properties. 3. Pursuant to Section 79C(1)(a)(ii) <strong>of</strong> the Environmental Planning and Assessment Act 1979, the proposal does not comply with Clause 74 – Provision <strong>of</strong> Parking contained within the Warringah Local Environmental Plan 2000. The proposed new dwelling does not provide carparking for two (2) vehicles. (Crs J Sutton/Smith) Record <strong>of</strong> Voting For: Crs J Sutton, Caputo, Colman, Forrest, Moxham, Smith, Stephens and R Sutton. Against: Cr Jones. NOTE 2: The original Motion moved by Cr Jones to the effect: “That the application be approved subject to size <strong>of</strong> the balcony being reduced by half ie 3.5 x 5.4 and that the balcony be provided with garden beds and suitable vegetation to be planted within and referred back to the Development Unit for the attachment <strong>of</strong> the appropriate conditions and dealt with under delegated authority by the General Manger.” LAPSED for want <strong>of</strong> a seconder.
