42. Excavati<strong>on</strong> work is to ensure the stability <str<strong>on</strong>g>of</str<strong>on</strong>g> the soil material <str<strong>on</strong>g>of</str<strong>on</strong>g> adjoining properties,<br />

the protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> adjoining buildings, services, structures and / or public infrastructure<br />

from damage using underpinning, shoring, retaining walls and support where required.<br />

All retaining walls are to be structurally adequate for the intended purpose, designed<br />

and certified by a structural engineer, except where site c<strong>on</strong>diti<strong>on</strong>s permit the<br />

following:<br />

a. maximum height <str<strong>on</strong>g>of</str<strong>on</strong>g> 900mm above or below ground level and at least 900mm<br />

from any property boundary, and<br />

b. comply with AS3700, AS3600 and AS1170 and timber walls with AS1720 and<br />

AS1170.<br />

Before excavati<strong>on</strong>, the resp<strong>on</strong>sible pers<strong>on</strong> must notify his intenti<strong>on</strong> to the adjoining<br />

owner/s and shall at the same time furnish to such owner/s particulars <str<strong>on</strong>g>of</str<strong>on</strong>g> the work<br />

proposed to be carried out. (C324)<br />

43. Adequate shoring to be provided to support the road reserve or other property during<br />

c<strong>on</strong>structi<strong>on</strong>. Engineering drawings <str<strong>on</strong>g>of</str<strong>on</strong>g> this work are to be provided and approved by<br />

Council prior to commencement <str<strong>on</strong>g>of</str<strong>on</strong>g> any excavati<strong>on</strong>s, likely to affect the stability <str<strong>on</strong>g>of</str<strong>on</strong>g> such<br />

road, reserve or property. (C94)<br />

44. The public footways and roadways adjacent to the site shall be maintained at all times<br />

during the course <str<strong>on</strong>g>of</str<strong>on</strong>g> the work in a safe c<strong>on</strong>diti<strong>on</strong>. (C88)<br />

PRIOR TO OCCUPATION<br />

45. The building shall not be occupied until an Occupati<strong>on</strong> Certificate has been issued.<br />

46. To ensure the safety <str<strong>on</strong>g>of</str<strong>on</strong>g> occupants <str<strong>on</strong>g>of</str<strong>on</strong>g> the building a “Fire Safety Certificate” which<br />

identifies the schedule <str<strong>on</strong>g>of</str<strong>on</strong>g> “Fire Safety Measures” that have been completed to<br />

satisfactory standard shall be provided to Council prior to the issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an “Occupati<strong>on</strong><br />

Certificate” as required in Part 7B <str<strong>on</strong>g>of</str<strong>on</strong>g> the “Envir<strong>on</strong>mental Planning and Assessment<br />

Amendment Act 1997”. (C387)<br />

47. The drainage works are to be c<strong>on</strong>structed generally in accordance with the drainage<br />

c<strong>on</strong>cept plan submitted by Bainbrigge Barnett & Partners P/L, Project No.020004,<br />

Drawing No. Figure 4 Issue A.On completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> works a Compliance Certificate and a<br />

Work as Executed plan are to be submitted to the principal certifying authority prior to<br />

occupati<strong>on</strong>. (C510)<br />

48. A Secti<strong>on</strong> 73 Compliance Certificate under the Sydney Water Act 1994 must be<br />

obtained. Applicati<strong>on</strong> must be made through an authorised Water Servicing<br />

Coordinator; for details see the Sydney Water web site<br />

www.sydneywater.com.au\customer\urban\index or teleph<strong>on</strong>e 13 20 92.<br />

Following applicati<strong>on</strong>, a “Notice <str<strong>on</strong>g>of</str<strong>on</strong>g> Requirements” will be forwarded detailing water<br />

and sewer extensi<strong>on</strong>s to be built and charges to be paid. Please make early c<strong>on</strong>tact with<br />

the Coordinator, since building <str<strong>on</strong>g>of</str<strong>on</strong>g> water/sewer extensi<strong>on</strong>s can be time c<strong>on</strong>suming and<br />

<strong>may</strong> impact <strong>on</strong> other services and building, driveway or landscape design.<br />

The Secti<strong>on</strong> 73 Certificate must be submitted to the Principal Certifying Authority prior<br />

to release <str<strong>on</strong>g>of</str<strong>on</strong>g> the linen plan/occupati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the development. (C58)<br />

49. The requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>(s) ending in code(s) (C93) shall be designed and<br />

supervised during the works by an Engineer with qualificati<strong>on</strong>s and expertise<br />

recognised by the Institute <str<strong>on</strong>g>of</str<strong>on</strong>g> Engineers Australia as being adequate for the purpose.<br />
