The Engineer shall certify prior to occupation or release <strong>of</strong> Linen Plan <strong>of</strong> Subdivision
that the works have been completed strictly in accordance with the approved design and
to appropriate standards <strong>of</strong> workmanship. (C98)
50. That the lift overrun be removed and a new low impact lift be installed.

NOTE:
There being an equality <strong>of</strong> votes the Chairman used her casting vote in favour
<strong>of</strong> the Motion which was carried.
NOTE 1: Unsuccessful Motion
The above decision was carried as an Amendment to the Original Motion and
thereupon became the Substantive Motion.

NOTE 2: Original Motion
The Original Motion was moved to the following effect by Crs R Sutton and Smith:
“That the application be refused because:
1. It is not helpful to change the usage <strong>of</strong> this building as there are insufficient
nursing home beds in the area.
2. We would lose 93 nursing home beds if this were changed to units.
3. We have an already large disproportionate number <strong>of</strong> people in the community
(as represented in this whole Council Chamber tonight) who are over, or
approaching the age <strong>of</strong> 60 and will be facing the need for this kind <strong>of</strong>
accommodation sooner rather than later.
4. This area should have some nursing home accommodation to share the
beautiful views available in the area and perhaps serviced apartments.
5. If we really respect the aged as we say we do, why aren’t we providing more,
rather than less, good nursing home accommodation for them in their most
senior and at times vulnerable years.
6. According to Section 23 Part (g) <strong>of</strong> our LEP 2000 if the development is
different from the land’s current use or any use for which it was <strong>held</strong> by the
Government Department it must go through the process <strong>of</strong> changing usage.”
NOTE 3: Crs Forrest and Moxham were absent from the Chamber during part consideration
and discussion <strong>of</strong> this Item.
