RECOMMENDATION OF LOCAL APPROVALS SERVICE UNIT MANAGER
That Council not oppose the Land & Environment Court granting Deferred Commencement
Consent Orders subject to the attached draft conditions, or minor variations to conditions
accepted by the Development Unit, for the application for Demolition <strong>of</strong> existing dwelling and
construction <strong>of</strong> a 3 storey residential flat building and basement car parking and drainage works
at Lot 9, DP 6643, No. 22 Pacific Parade, Dee Why.
DEFERRED COMMENCEMENT
A This Deferred Commencement Consent is granted under Section 80(3) <strong>of</strong> the
Environmental Planning and Assessment Act, 1979 and shall not operate until the
applicant produces evidence to the Council sufficient to enable it to be satisfied as to the
following matters:-
1. That the appropriate approval and consents have been obtained for the proposed
drainage works on the adjoining site No. 20 Pacific Parade, SP 1084.
2. That an easement 3 metres wide for drainage purposes has been created over the
subject site and the adjoining site No. 20 Pacific Parade replacing the existing water
course for the proposed drainage works.

GENERAL CONDITIONS
1. Development being generally in accordance with plans numbered DA1E to DA9E,
dated 1.05.02, LDA-3 dated 1.05.02 and Engineering Plans 36001-1to 2/B and 36001-
3/A dated 19.4.02 as modified by any conditions <strong>of</strong> this consent/approval. (C1)
2. Compliance with Building Code <strong>of</strong> Australia
a. All building work must be carried out in accordance with the provisions <strong>of</strong> the
Building Code <strong>of</strong> Australia.
