The Original Moti<strong>on</strong> was moved to the following effect by Crs Forrest and Smith:<br />
“That the applicati<strong>on</strong> for demoliti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> three dwelling houses and c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a 3<br />
storey apartment building comprising 24 units, 33 carparking spaces and landscaping<br />
at Lot B, DP 341705, Lot B, DP 347940 and Lot B, DP 395640, Nos 19-23 Waine<br />
Street, Harbord, be refused for the following reas<strong>on</strong>s:<br />
1. Pursuant to Secti<strong>on</strong> 79 (c) <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act, as amended, the proposal is<br />
inc<strong>on</strong>sistent with the general principles <str<strong>on</strong>g>of</str<strong>on</strong>g> the LEP 2000 clause 65 in respect to<br />
privacy and will have an adverse impact <strong>on</strong> the amenity <str<strong>on</strong>g>of</str<strong>on</strong>g> adjoining residents<br />
with the design overlooking habitable rooms and principal private spaces <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
other dwellings.<br />
2. Pursuant to Secti<strong>on</strong> 79 (c) <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act, as amended, the proposal is<br />
inc<strong>on</strong>sistent with the general principles <str<strong>on</strong>g>of</str<strong>on</strong>g> the LEP 2000 with respect to clause<br />
61, views, resulting in an adverse impact <strong>on</strong> the amenity <str<strong>on</strong>g>of</str<strong>on</strong>g> adjoining residents<br />
with a design that does not allow for the reas<strong>on</strong>able sharing <str<strong>on</strong>g>of</str<strong>on</strong>g> views.<br />
3. Pursuant to Secti<strong>on</strong> 79 (c) <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act, as amended, the proposal is<br />
inc<strong>on</strong>sistent with the general principles <str<strong>on</strong>g>of</str<strong>on</strong>g> the LEP 2000 as the proposal fails to<br />
comply with the objectives <str<strong>on</strong>g>of</str<strong>on</strong>g> the minimum area <str<strong>on</strong>g>of</str<strong>on</strong>g> landscaped open space<br />
requirement <str<strong>on</strong>g>of</str<strong>on</strong>g> 50% <str<strong>on</strong>g>of</str<strong>on</strong>g> the site area.<br />
4. Pursuant to Secti<strong>on</strong> 79 (c) <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act, as amended, the proposal is<br />
inc<strong>on</strong>sistent with the general principles <str<strong>on</strong>g>of</str<strong>on</strong>g> the LEP 2000 as the proposal is<br />
c<strong>on</strong>sidered by virtue <str<strong>on</strong>g>of</str<strong>on</strong>g> its design, height, bulk and locati<strong>on</strong>, incompatible with<br />
the character <str<strong>on</strong>g>of</str<strong>on</strong>g> the adjoining properties.<br />
5. Pursuant to Secti<strong>on</strong> 79 (c) <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act, as amended, the proposal is<br />
inc<strong>on</strong>sistent with the general principles <str<strong>on</strong>g>of</str<strong>on</strong>g> the LEP 2000 as the proposal is<br />
c<strong>on</strong>sidered inc<strong>on</strong>sistent with the pattern <str<strong>on</strong>g>of</str<strong>on</strong>g> existing adjoining properties with a<br />
design that represents an undesirable relati<strong>on</strong>ship in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the local c<strong>on</strong>text.<br />
6. Pursuant to Secti<strong>on</strong> 79 (c) <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act, as amended, the proposal is<br />
inc<strong>on</strong>sistent with the general principles <str<strong>on</strong>g>of</str<strong>on</strong>g> the LEP 2000 as the proposal is<br />
c<strong>on</strong>sidered to have an unfavourable impact <strong>on</strong> traffic safety, access and parking<br />
in the dead end street <str<strong>on</strong>g>of</str<strong>on</strong>g> Waine Street.”<br />
NOTE 3: Disorderly C<strong>on</strong>duct<br />
At 9.26pm, during debate <strong>on</strong> this Item, the Mayor, in accordance with the Council’s<br />
Code <str<strong>on</strong>g>of</str<strong>on</strong>g> Meeting Practice, advised Cr Forrest that he was in an act <str<strong>on</strong>g>of</str<strong>on</strong>g> disorder for his<br />
