the release <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>structi<strong>on</strong> Certificate (to be paid into Account WCP 20340<br />
0999),<br />
e. Up<strong>on</strong> completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the works, the applicant is to provide to Council 2 copies <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
“work as executed plans”. The plans are to show relevant dimensi<strong>on</strong>s and<br />
finished levels and are to be certified by a surveyor. Also the applicant is to<br />
provide to Council in an approved format details <str<strong>on</strong>g>of</str<strong>on</strong>g> all public infrastructure<br />
created as part <str<strong>on</strong>g>of</str<strong>on</strong>g> the works,<br />
f. All Civil Engineering works in Pacific Parade are to be fully supervised by the<br />
c<strong>on</strong>sultant resp<strong>on</strong>sible for their design, or by such pers<strong>on</strong> as <strong>may</strong> be approved by<br />
Council, and <strong>on</strong> completi<strong>on</strong> certified to be in accordance with the approved plans,<br />
c<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>structi<strong>on</strong> and Council’s standard specificati<strong>on</strong> for engineering<br />
works,<br />
g. A maintenance period <str<strong>on</strong>g>of</str<strong>on</strong>g> six (6) m<strong>on</strong>ths shall apply to the work, after it has been<br />
completed and approved in writing by Council or the Principal Certifying<br />
Authority. In that period the applicant shall be liable for any part <str<strong>on</strong>g>of</str<strong>on</strong>g> the work<br />
which fails to perform in the manner outlined in Council’s specificati<strong>on</strong>s, or as<br />
would reas<strong>on</strong>ably be expected under the design c<strong>on</strong>diti<strong>on</strong>s.<br />
Council will require a C<strong>on</strong>structi<strong>on</strong> Security Deposit/Bank Guarantee <str<strong>on</strong>g>of</str<strong>on</strong>g> $200,000<br />
prior to issue <str<strong>on</strong>g>of</str<strong>on</strong>g> C<strong>on</strong>structi<strong>on</strong> Certificate to be refunded and replaced at completi<strong>on</strong> by<br />
a $25,000 Maintenance Security Deposit/Bank Guarantee to ensure rectificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> any<br />
defects during the maintenance period. (C93)<br />
30. Prior to finalising detailed designs <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposed development, the applicant should<br />
check all existing public service utilities adjacent to the site and ensure that where<br />
necessary appropriate arrangements are made for the relocati<strong>on</strong> and/or adjustment <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
any services at the applicant’s expense. (C96)<br />
31. The developer/applicant is to obtain a “Road Opening Permit” from Council and pay<br />
all appropriate charges prior to commencement <str<strong>on</strong>g>of</str<strong>on</strong>g> any work <strong>on</strong> Council property.<br />
The developer/applicant shall be resp<strong>on</strong>sible for all public utilities and services in the<br />
area <str<strong>on</strong>g>of</str<strong>on</strong>g> the work, and as such shall notify all relevant Authorities, and bear all costs<br />
associated with any repairs and/or adjustments as those Authorities <strong>may</strong> deem<br />
necessary. (C113)<br />
32. The payment <str<strong>on</strong>g>of</str<strong>on</strong>g> $5,000 to account Reg 009 - *TF 036 prior to issue <str<strong>on</strong>g>of</str<strong>on</strong>g> a c<strong>on</strong>structi<strong>on</strong><br />
certificate as security to ensure that:<br />
a. all silt and sediment c<strong>on</strong>trol measures are installed and maintained;<br />
b. there is no transmissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> material, soil etc <str<strong>on</strong>g>of</str<strong>on</strong>g>f the site and <strong>on</strong>to the public road<br />
and/or drainage systems; and<br />
c. maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g> all facilities in accordance with Council’s Specificati<strong>on</strong> for<br />
Erosi<strong>on</strong> C<strong>on</strong>trol and Sediment C<strong>on</strong>trol. (C42)<br />
33. Adequate shoring to be provided to support the road reserve or other property during<br />
c<strong>on</strong>structi<strong>on</strong>. Engineering drawings <str<strong>on</strong>g>of</str<strong>on</strong>g> this work are to be provided and approved by<br />
Council prior to commencement <str<strong>on</strong>g>of</str<strong>on</strong>g> any excavati<strong>on</strong>s, likely to affect the stability <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
such road, reserve or property. (C94)<br />
34. A Secti<strong>on</strong> 73 Compliance Certificate under the Sydney Water Act 1994 must be<br />
obtained. Applicati<strong>on</strong> must be made through an authorised Water Servicing<br />
