setback <strong>of</strong> 6 metres for the existing dwelling on proposed Lot 52. In this regard, the
rear setback is 2.14m.
3. Pursuant to Section 79C (1) (a) (i) <strong>of</strong> the Environmental Planning and Assessment Act,
1979, as amended, and Clause 64 <strong>of</strong> Warringah Local Environmental Plan 2000, the
proposal does not provide adequate private open space for the existing dwelling on
proposed Lot 52. In this regard, the provision <strong>of</strong> private open space does not comply
with the minimum required area, is not directly accessible from the living areas <strong>of</strong> the
dwelling.
4. Pursuant to Section 79C (1) (a) (i) <strong>of</strong> the Environmental Planning and Assessment Act,
1979, as amended, and Appendix A – Locality A3 “Terrey Hills Village” <strong>of</strong> Warringah
Local Environmental Plan 2000, the proposal is inconsistent with the Desired Future
Character <strong>of</strong> the Locality. In this regard, the proposed lot sizes are not consistent with
the pattern <strong>of</strong> lot sizes in the surrounding area.
5. Pursuant to Section 79C (1) (e) <strong>of</strong> the Environmental Planning and Assessment Act,
1979, as amended, the proposal is contrary to the public interest, in terms <strong>of</strong> the
resident submissions in opposition to the proposal.
6. The proposal represents an overdevelopment <strong>of</strong> the site.
