52. The requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>(s) ending in code(s) C93 shall be designed and<br />

supervised during the works by an Engineer with qualificati<strong>on</strong>s and expertise<br />

recognised by the Institute <str<strong>on</strong>g>of</str<strong>on</strong>g> Engineers Australia as being adequate for the purpose.<br />

The Engineer shall certify prior to occupati<strong>on</strong> or release <str<strong>on</strong>g>of</str<strong>on</strong>g> Linen Plan <str<strong>on</strong>g>of</str<strong>on</strong>g> Subdivisi<strong>on</strong><br />

that the works have been completed strictly in accordance with the approved design<br />

and to appropriate standards <str<strong>on</strong>g>of</str<strong>on</strong>g> workmanship. (C98)<br />

53. Retaining Walls and Drainage.<br />

If the soil c<strong>on</strong>diti<strong>on</strong>s require it:<br />

a. retaining walls associated with the erecti<strong>on</strong> or demoliti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a building or other<br />

approved methods <str<strong>on</strong>g>of</str<strong>on</strong>g> preventing movement <str<strong>on</strong>g>of</str<strong>on</strong>g> the soil must be provided, and<br />

b. adequate provisi<strong>on</strong> must be made for drainage. (C379)<br />

54. Trade materials, product and plant to be kept within the c<strong>on</strong>fines <str<strong>on</strong>g>of</str<strong>on</strong>g> the building at all<br />

times. (C30)<br />

55. The public footways and roadways adjacent to the site shall be maintained at all times<br />

during the course <str<strong>on</strong>g>of</str<strong>on</strong>g> the work in a safe c<strong>on</strong>diti<strong>on</strong>. (C88)<br />

PRIOR TO OCCUPATION<br />

56. The building shall not be occupied until an Occupati<strong>on</strong> Certificate has been issued.<br />

57. To ensure the safety <str<strong>on</strong>g>of</str<strong>on</strong>g> occupants <str<strong>on</strong>g>of</str<strong>on</strong>g> the building a “Fire Safety Certificate” which<br />

identifies the schedule <str<strong>on</strong>g>of</str<strong>on</strong>g> “Fire Safety Measures” that have been completed to<br />

satisfactory standard shall be provided to Council prior to the issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an “Occupati<strong>on</strong><br />

Certificate” as required in Part 7B <str<strong>on</strong>g>of</str<strong>on</strong>g> the “Envir<strong>on</strong>mental Planning and Assessment<br />

Amendment Act 1997”. (C387)<br />

58. Street number being affixed to building prior to occupati<strong>on</strong>. (C322)<br />

59. Where any c<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> this C<strong>on</strong>sent require dedicati<strong>on</strong>, c<strong>on</strong>solidati<strong>on</strong>, easement or<br />

covenant, the number allocated by the Land Titles Office to the documents and/or<br />

plans referred to shall be advised in writing to Warringah Council, together with a<br />

letter <str<strong>on</strong>g>of</str<strong>on</strong>g> intent to proceed with the Creati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the easement, prior to Occupati<strong>on</strong>. A<br />

certified copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the documents shall be provided to Warringah Council after final<br />

approval and registrati<strong>on</strong> has been effected by the Land Titles Office. (C57)<br />

60. Reinstatement <str<strong>on</strong>g>of</str<strong>on</strong>g> redundant crossings and laybacks prior to issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the final<br />

Compliance Certificate. (C91)<br />

61. A declarati<strong>on</strong> by a registered surveyor shall be provided to evidence that all<br />

c<strong>on</strong>structi<strong>on</strong> has been effected within the appropriate property and easement<br />

boundaries. This shall be in the form <str<strong>on</strong>g>of</str<strong>on</strong>g> a copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the final subdivisi<strong>on</strong> or easement<br />

plan, with the distances from the boundaries to the edges <str<strong>on</strong>g>of</str<strong>on</strong>g> these structures endorsed<br />

in red there<strong>on</strong> and signed by the surveyor. (C97)<br />
