Minutes <str<strong>on</strong>g>of</str<strong>on</strong>g> Council Meeting <strong>on</strong> <strong>21</strong> May 2002<br />
showing a complete disregard for his duties as a public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial and diligence as required<br />
by the Local Government Act.<br />
3. Note with c<strong>on</strong>cern that <strong>on</strong> practically every occasi<strong>on</strong> Councillor Ruth Sutt<strong>on</strong> rises to speak,<br />
Councillor Moxham leaves the Chamber and <str<strong>on</strong>g>of</str<strong>on</strong>g>ten will <strong>on</strong>ly return when the vote is to be<br />
taken.<br />
4. Note that in State and Federal Parliament it is c<strong>on</strong>trary to the Standing Orders <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />
Parliament for any member <str<strong>on</strong>g>of</str<strong>on</strong>g> either House or the Senate to have or be reading a<br />
newspaper while the Business <str<strong>on</strong>g>of</str<strong>on</strong>g> the Chamber is being debated or c<strong>on</strong>sidered.<br />
5. Censure Councillor Moxham for his failure to listen to and show due diligence in his role<br />
as a public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial.<br />
6. In view <str<strong>on</strong>g>of</str<strong>on</strong>g> Councillor Moxham’s behaviour which is adversely affecting the integrity <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
Council decisi<strong>on</strong>s, Council’s Code for the C<strong>on</strong>duct <str<strong>on</strong>g>of</str<strong>on</strong>g> Meetings be amended and the<br />
following be inserted:<br />
“The reading <str<strong>on</strong>g>of</str<strong>on</strong>g> newspapers, books, magazines by Councillors during a Council <str<strong>on</strong>g>meeting</str<strong>on</strong>g> is<br />
prohibited and is an act <str<strong>on</strong>g>of</str<strong>on</strong>g> disorder unless the Councillor is directly quoting from such<br />
material during debate.”<br />
NOTE 1: Crs J<strong>on</strong>es and Stephens moved an Amendment to the Moti<strong>on</strong> to the following effect:<br />
“1. That Council’s Code <str<strong>on</strong>g>of</str<strong>on</strong>g> C<strong>on</strong>duct be amended to allow Council to censure a<br />
Councillor or number <str<strong>on</strong>g>of</str<strong>on</strong>g> Councillors who wilfully and deliberately leaves a<br />
Council Meeting in order that the <str<strong>on</strong>g>meeting</str<strong>on</strong>g> has to aband<strong>on</strong>ed through lack <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />
quorum.<br />
2. Council c<strong>on</strong>gratulate Cr Moxham <strong>on</strong> the diligent way he fulfils his duties as a<br />
Councillor.”<br />
NOTE 2: Cr Forrest raised a point <str<strong>on</strong>g>of</str<strong>on</strong>g> order that the amendment was out <str<strong>on</strong>g>of</str<strong>on</strong>g> order in accordance<br />
with Clause 19.<br />
The Mayor ruled there was no point <str<strong>on</strong>g>of</str<strong>on</strong>g> order.<br />
NOTE 3: Moti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Dissent<br />
Crs Forrest and Smith moved a Moti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Dissent to the Mayor’s ruling.<br />
