Minutes <strong>of</strong> Council Meeting on 21 May 2002
showing a complete disregard for his duties as a public <strong>of</strong>ficial and diligence as required
by the Local Government Act.
3. Note with concern that on practically every occasion Councillor Ruth Sutton rises to speak,
Councillor Moxham leaves the Chamber and <strong>of</strong>ten will only return when the vote is to be
taken.
4. Note that in State and Federal Parliament it is contrary to the Standing Orders <strong>of</strong> the
Parliament for any member <strong>of</strong> either House or the Senate to have or be reading a
newspaper while the Business <strong>of</strong> the Chamber is being debated or considered.
5. Censure Councillor Moxham for his failure to listen to and show due diligence in his role
as a public <strong>of</strong>ficial.
6. In view <strong>of</strong> Councillor Moxham’s behaviour which is adversely affecting the integrity <strong>of</strong>
Council decisions, Council’s Code for the Conduct <strong>of</strong> Meetings be amended and the
following be inserted:
“The reading <strong>of</strong> newspapers, books, magazines by Councillors during a Council <strong>meeting</strong> is
prohibited and is an act <strong>of</strong> disorder unless the Councillor is directly quoting from such
material during debate.”
NOTE 1: Crs Jones and Stephens moved an Amendment to the Motion to the following effect:
“1. That Council’s Code <strong>of</strong> Conduct be amended to allow Council to censure a
Councillor or number <strong>of</strong> Councillors who wilfully and deliberately leaves a
Council Meeting in order that the <strong>meeting</strong> has to abandoned through lack <strong>of</strong> a
quorum.
2. Council congratulate Cr Moxham on the diligent way he fulfils his duties as a
Councillor.”
NOTE 2: Cr Forrest raised a point <strong>of</strong> order that the amendment was out <strong>of</strong> order in accordance
with Clause 19.
The Mayor ruled there was no point <strong>of</strong> order.
NOTE 3: Motion <strong>of</strong> Dissent
Crs Forrest and Smith moved a Motion <strong>of</strong> Dissent to the Mayor’s ruling.
