The Center for Legal Assistance to Polluti<strong>on</strong> Victims (CLAPV)<br />

was established in October 1998 by China University of<br />

Political Science <strong>and</strong> Law <strong>and</strong> registered with the Judicial<br />

Ministry of the PRC. They work together with legal experts<br />

<strong>and</strong> scholars to provide free legal advice for polluti<strong>on</strong> victims<br />

applying via a hotline, letter or pers<strong>on</strong>al visit.<br />

Project Outline - Objectives <strong>and</strong> <strong>Activities</strong><br />

CLAPV aims to safeguard the envir<strong>on</strong>mental rights <strong>and</strong> interests of polluti<strong>on</strong> victims via provisi<strong>on</strong> of<br />

assistance in court proceedings, which also increases public awareness of envir<strong>on</strong>mental <strong>and</strong> legal rights,<br />

thus promoting the enforcement <strong>and</strong> compliance of Chinese envir<strong>on</strong>mental laws. CLAPV’s objectives<br />

include envir<strong>on</strong>mental law enforcement training, raising public awareness <strong>and</strong> improving envir<strong>on</strong>mental<br />

legislati<strong>on</strong> <strong>and</strong> assuring compliance with the Envir<strong>on</strong>mental <strong>and</strong> Natural Resources Law.<br />

Impacts <strong>and</strong> Achievements<br />

CLAPV offers legal assistance to envir<strong>on</strong>mental victims. Through June 2010, CLAPV had assisted in 150<br />

envir<strong>on</strong>mental polluti<strong>on</strong> cases, most of which have broadly impacted <strong>on</strong> society as they closely relate to<br />

property, health <strong>and</strong> even lives of citizens. As a result of CLAPV’s activities in securing envir<strong>on</strong>mental rights<br />

via legal means, the pressure is now <strong>on</strong> enterprises that have infringed rules or damaged the envir<strong>on</strong>ment<br />

<strong>and</strong> local governments lax in envir<strong>on</strong>mental protecti<strong>on</strong>. This raises public awareness of the need to protect<br />

their envir<strong>on</strong>mental rights. CLAPV is also resp<strong>on</strong>sible for enactment <strong>and</strong> amendment of most of China’s<br />

envir<strong>on</strong>mental laws.<br />

Future Challenges<br />

The challenges are to c<strong>on</strong>tinue the hotline <strong>and</strong> <strong>on</strong>going training of legal pers<strong>on</strong>el in envir<strong>on</strong>mental<br />

practice, as well as creati<strong>on</strong> of c<strong>on</strong>sultancies <strong>and</strong> holding of seminars for NGOs <strong>and</strong> journalists. Although<br />

CLAPV has set up an envir<strong>on</strong>mental public interest law firm, which will play an important role in training<br />

envir<strong>on</strong>mental lawyers, more financial <strong>and</strong> programme support is needed to attract more full-time layers<br />

into litigati<strong>on</strong> <strong>and</strong> research, as well as to help form an overall envir<strong>on</strong>mental legal system.<br />
