Background - Problems Addressed <strong>and</strong> Policy Resp<strong>on</strong>ses<br />

Effective envir<strong>on</strong>mental law enforcement is a prerequisite<br />

for protecting the envir<strong>on</strong>ment in Bangladesh. The Right<br />

to Informati<strong>on</strong> Act of 2008 was expected to ensure public<br />

access to such informati<strong>on</strong>, but the administrative processes<br />

involved make this very difficult. It is therefore essential to<br />

raise public awareness, prompt proactive participati<strong>on</strong>, <strong>and</strong><br />

train lawyers <strong>and</strong> envir<strong>on</strong>mental leaders.<br />

Project Outline - Objectives <strong>and</strong> <strong>Activities</strong><br />

The project is intended to promote stakeholder dialogues <strong>on</strong> public access to envir<strong>on</strong>mental informati<strong>on</strong>,<br />

to undertake an assessment of policy <strong>and</strong> instituti<strong>on</strong>al frameworks <strong>and</strong> to c<strong>on</strong>duct case studies <strong>and</strong><br />

provide training for envir<strong>on</strong>mental lawyers, practiti<strong>on</strong>ers <strong>and</strong> envir<strong>on</strong>mental leaders. The Bangladesh<br />

Envir<strong>on</strong>mental Lawyers Associati<strong>on</strong> (BELA) has undertaken activities including 12 studies to cover<br />

issues such as mining, waste, aquaculture, <strong>and</strong> participatory resource management, <strong>and</strong> to provide the<br />

government with recommendati<strong>on</strong>s for improving envir<strong>on</strong>mental legal systems.<br />

Impacts <strong>and</strong> Achievements<br />

The assessment delineated gaps <strong>and</strong> challenges in enabling the public to obtain envir<strong>on</strong>mental<br />

informati<strong>on</strong>, to promote participatory decisi<strong>on</strong>-making <strong>and</strong> to ensure social justice in proceedings; Twelve<br />

case studies elucidated the driving forces in envir<strong>on</strong>mental damage <strong>and</strong> depleti<strong>on</strong> of natural resources <strong>and</strong><br />

provided countermeasures; Societal <strong>and</strong> community-based network organisati<strong>on</strong>s were strengthened;<br />

Awareness of decisi<strong>on</strong> makers, officials <strong>and</strong> stakeholders <strong>on</strong> ways to promote effective envir<strong>on</strong>mental law<br />

implementati<strong>on</strong> was raised; Platforms to build partnership for undertaking collaborative activities were<br />

created; <strong>and</strong> the 2009 Goldman Envir<strong>on</strong>ment Award was awarded to the BELA Director.<br />

Future Challenges<br />

The Right to Informati<strong>on</strong> Act of 2008 must be operati<strong>on</strong>alised to foster the flow of envir<strong>on</strong>mental<br />

informati<strong>on</strong> to the public; Legislative or administrative measures need to be strengthened to compel<br />

agencies <strong>and</strong> businesses to disclose envir<strong>on</strong>mental informati<strong>on</strong>; The mechanisms need to be strengthened<br />

to eliminate corrupti<strong>on</strong> in envir<strong>on</strong>mental law administrati<strong>on</strong>; Legal provisi<strong>on</strong>s <strong>on</strong> public participati<strong>on</strong><br />

must be further elaborated; Compliance with informati<strong>on</strong>-disclosure requirements <strong>and</strong> development of<br />

enforcement procedures need to be m<strong>on</strong>itored.<br />
