They are contained at the end so that when the contract is awarded, they can beremoved.4.5.4.1 Section K: Representations, certifications, and other statements <strong>of</strong> <strong>of</strong>ferors(incorporated by reference). Section K identifies requirements <strong>for</strong> contractor representations,certifications, and binding statements. Usually, these requirements are identified by contractualclauses in Section I. The contracting <strong>of</strong>ficer prepares Section K after preparing other Sections.Contract clauses in other Sections may specify a contractor representation, certification, orbinding statement.4.5.4.2 Section L: Instructions, conditions, and notices to <strong>of</strong>ferors. Use this Section toprovide in<strong>for</strong>mation, instructions and RFP provisions not included in other Sections. Providein<strong>for</strong>mation to guide contractors in preparing proposals or quotations. Section L may alsoinclude contract clauses by reference as in Section I and other Sections. The following <strong>guidance</strong>applies to preparation <strong>of</strong> Section L:a. Instruct prospective <strong>of</strong>ferors to submit proposals in several parts to meet agencyrequirements. Technical, and costing or pricing data should be in separate parts <strong>of</strong> theproposal. This eliminates the need <strong>for</strong> the contracting <strong>of</strong>ficer to separate the costingin<strong>for</strong>mation from the package be<strong>for</strong>e giving it to the technical evaluation team.Additional instructions on proposal <strong>for</strong>mat may also include parts on management andadministrative data. Also identify requirements to include technical literature with theproposal.b. A good proposal structure helps to conduct an efficient source selection evaluation.Clearly describe the required proposal structure in this Section. Provide detailedinstruction on the organization, content, and <strong>for</strong>mat <strong>of</strong> the <strong>of</strong>feror's proposal. Ensure thatSection L proposal requirements match those in Section C. Also match Section Lin<strong>for</strong>mation with evaluation factors and criteria in Section M. A concurrent development<strong>of</strong> Sections C, L, and M will protect against inconsistencies between Sections. As theSections are being written, determine how to evaluate the requirement and how thecontractor's proposal should address each requirement.c. Include any provisions <strong>for</strong> excluding an <strong>of</strong>feror's proposal as being frivolous orunresponsive in this Section. Give the <strong>of</strong>feror enough in<strong>for</strong>mation about what isconsidered frivolous or unresponsive to prevent any misunderstandings.d. Provide instructions on how to obtain copies <strong>of</strong> documents cited that are not providedwith the package.23
