Provisions of this lawrequire the anti-corruption Agency, with the aim of implementation of anticorruptionStrategy, to draft an Action Plan against corruption in cooperationwith the responsible institutions of the Republic of Kosovo, a document thatcontains concrete measures against corruption that must be implemented byinstitutions in the central and at the local level of government. The Agencymonitors the implementation of the Action Plan against Corruption by theKosovo institutions at the central level and the local level. And for theprogress of implementation of Strategy and Action Plan, the Agency reportsto the Kosovo Assembly in its annual report (Law on Anti-corruptionAgency: art.17).The Law on anti-corruption Agency contains provisions, which regulatepreliminary investigation procedure in data protection and storage, recordkeeping and confidentiality of information. Pursuant to provisions of thislaw, the Agency conducts the procedure of preliminary investigation in caseof suspicion of corruption, according to: 1. official duty; or 2. according tothe information received by natural and legal persons (Art. 18, para.1).During the period for 2009, Kosovo Anti Corruption Agency, through theDepartment of Investigation has received a considerable number of cases ofsuspicion of corruption; respectively total 175 cases (Anti-corruptionKosovo Agency Annual Report 2009).This number is obviously higher thanprevious years, which is evidence of an increase in citizens’ trust toward theAgency’s work. Based on data of the Annual Report of Kosovo Anticorruption Agency, for 2009, which is referred to cases of suspicion ofcorruption filed by citizens and those investigated as per official duty by theAgency, related to officials in institutions and bodies as follow: courts with53 cases or 30,2%; other institutions (International Airport of Prishtina, Postand Telecommunication of Kosovo, Kosovo Energy Corporation, KosovoRailways, Kosovo Privatization Agency, former Socially OwnedEnterprises, Kosovo Customs etc.) with 43 corruptive cases or 24,5%;Government of Republic of Kosovo (ministries and agencies acting withindesignated ministries) with 34 cases or 19,4%; local government(municipalities of Republic of Kosovo) with 31 cases or 17,7%; and theprocurements of Republic of Kosovo with 14 or 8% of cases with suspicionof corruption (Anti-corruption Kosovo Agency Annual Report 2009).In compliance with provisions of the Law on Anti Corruption Agency(Art.5, para.1.1), the Agency, upon preliminary review of the cases withsuspicion of corruption, gathering sufficient evidences to verify the allegedfacts for these actions of officials in public institutions and other bodies, and68
