1.3 Purpose <strong>of</strong> the <strong>REF</strong>For an activity subject to Part 5 <strong>of</strong> the EP&A Act, section 111 <strong>of</strong> the Act imposes a duty on adetermining authority to ‘examine and take into account to the fullest extent possible all mattersaffecting or likely to affect the environment by reason <strong>of</strong> that activity’. Determining authoritiesmake a determination about whether a proposal can proceed, and on what basis.The purpose <strong>of</strong> this report is to summarise the results <strong>of</strong> the environmental impact assessmentfor the proposal and provide information about the proposal as an input to the determinationprocess. The determining authority will consider the findings <strong>of</strong> the <strong>REF</strong> as part <strong>of</strong> thedetermination process.In summary, the <strong>REF</strong> will assist the determining authority (Transport for NSW):1. Determine whether the proposal should be approved, taking into account to the fullestextent possible all matters affecting or likely to affect the environment (in accordance withsection 111 <strong>of</strong> the EP&A Act).2. Determine whether the proposal is likely to have a significant effect on the environment orsignificantly affect threatened species, populations or ecological communities or theirhabitats. If this is the case, an environmental impact statement and/or species impactstatement would need to be prepared and considered (in accordance with section 112 <strong>of</strong>the EP&A Act).3. Develop appropriate conditions (based on the mitigation measures recommended withinthe <strong>REF</strong>) to be attached to any approval granted.1.4 Structure <strong>of</strong> the <strong>REF</strong>The structure <strong>of</strong> the <strong>REF</strong> is outlined below:Part A - Introduction and contextProvides background information for the <strong>REF</strong>, including:• Section 1 – an introduction to the <strong>REF</strong>.• Section 2 – a description <strong>of</strong> the location, site and study area.• Section 3 – an overview <strong>of</strong> the statutory requirements for the proposal, including therequirements <strong>of</strong> relevant environmental planning instruments and legislation.Part B – The proposalProvides information on the proposal, including:• Section 4 – the strategic context for the proposal, need, and the proposal developmentprocess.• Section 5 – a description <strong>of</strong> the proposal.• Section 6 – a summary <strong>of</strong> the community and stakeholder consultation process and thekey issues raised to date.Part C – <strong>Environmental</strong> impact assessmentProvides an assessment <strong>of</strong> the potential impacts <strong>of</strong> the proposal:• Section 7 -12 – summarises the assessment <strong>of</strong> the key potential environmental impacts,including traffic and transport, heritage, noise and vibration, visual amenity, socioeconomicsand land use, and sustainability and waste.GHD | Transport for NSW - <strong>Monorail</strong> <strong>Removal</strong> <strong>Project</strong> <strong>REF</strong> | 3
