The new reference offer based on the Review of the Remedies Decision of September 17<br />

2010 is not yet in force. At the moment a draft of the reference offer was written by the<br />

incumbent. The public consultation is still pending.<br />

� Is multi-cast technology available for alternative operators (e.g. as part of the regulated<br />

product)?<br />

The new Remedies Decision for Market 5 is in force since September 17 2010. The<br />

provision of a multicast product has not been mandated explicitly because it is part of the<br />

obligation to grant bitstream access in general. Its actual provision depends on the<br />

availability of suitable technology:<br />

� ATM-Bitstream: no<br />

� Ethernet-Bitstream: mandated but not yet available<br />

� IP-Bitstream if Ethernet-based: mandated but not yet available<br />

More specific questions regarding bitstream resulting from the Commission’s Draft <strong>NGA</strong><br />

Recommendation:<br />

� Did your NRA apply exceptions (e.g., in certain geographic areas) from imposing<br />

wholesale bitstream access on SMP providers? If so, elaborate on the reasoning of that<br />

decision. The Draft <strong>NGA</strong> Recommendation foresees in Art. 37 the possibility of removing a<br />

bitstream access obligation if access to the fibre loop, in a given geographic area, results<br />

in effective competition.<br />
