3.3 Cabinet unbundling<br />

a) Not currently available.<br />

<strong>BoR</strong> (<strong>11</strong>) <strong>06b</strong><br />

b) Product definition: copper unbundling between the Cabinet end user CPE of the FTTN<br />

<strong>NGA</strong> network.<br />

c) Included in Market 4.<br />

d) Current regulatory obligations: could be available since 2013. Such remedy, still<br />

under discussion, has been proposed by Agcom within public consultation issued with<br />

decision 1/<strong>11</strong>/CONS; includes:<br />

� transparency obligation;<br />

� availability of reference offer;<br />

� non-discrimination obligations;<br />

� access obligations (Local exchange collocation + access to ducts or dark fiber to<br />

reach the concentration point).<br />

e) Costing: LRIC.<br />

f) Pricing: LRIC + risk premium included in the cost of capital.<br />

g) Not applicable.<br />

3.4 ODF unbundling<br />

It is not foreseen in the Agcom public consultation issued with decision 1/<strong>11</strong>/CONS. Such<br />

remedy could be evaluated following to further developments of WDM technology.<br />

More specific questions regarding fibre unbundling mainly resulting from the Commission’s<br />

Draft <strong>NGA</strong> Recommendation:<br />

� Specify for Market 4 which of the remedies according to Art. 9-13 AD are in place with<br />

regard to FttH/B and FttN.<br />

� Access to ducts<br />

� Access to dark fiber<br />

� Communication to Agcom and OLOs, with enough notice period, of <strong>NGA</strong>N<br />

development plans<br />

� Provision of a database of passive infrastructures.<br />
