� Are there any specific provisions for decommissioning MDFs that may help to create a<br />

level playing field and avoid discriminatory situations? E.g., is a certain notice period<br />

required so that competitors are informed about such decommissioning a reasonable<br />

period in advance, thereby avoiding discriminatory situations? 2<br />

Notice period of 5 years where COLO present & only 1 year where no COLO is present<br />

(access obligation).<br />

� Elaborate on the rationale for allowing or not allowing a decommissioning of MDFs, and<br />

any conditions involved. E.g., approval for a phase-out may be made contingent upon the<br />

availability of an equivalent alternative wholesale product. 3<br />

Due to closing of MDFs and limited business case for sub loop-unbundling incumbent<br />

needs to create bitstream offer that is worthy alternative.<br />

� Comparable quality diversifications as current bitstream offer.<br />

� Comparable functionality options as with BRUO to create product competition.<br />

Freedom to use every functionality available in the DSLAM even when BGC doesn‟t<br />

use them for their retail services.<br />

� Different levels to connect with the Ethernet network<br />

� possibility for OLO to use their existing fibre network for collection and transport of<br />

backhaul traffic.<br />

� In its <strong>report</strong> “<strong>NGA</strong> – Implementation Issues and Best Practice” 4 <strong>BEREC</strong> suggested that “in<br />

addition to the reference offer – wholesale customers should be able to obtain relevant<br />
