3.2 Concentration point/ manhole unbundling<br />

<strong>BoR</strong> (<strong>11</strong>) <strong>06b</strong><br />

a) Available on a mandated basis (current SMP decision: Wholesale unbundled access<br />

(including shared access) to metallic loops and sub-loops, for the purpose of providing<br />

broadband and voice services market; current Reference Infrastructure Access Offer for<br />

Cable Ducts; planned SMP Market 4 decision). Number of the respective wholesale<br />

products: We do not dispose information about unbundling loops in concentration<br />

point/manhole unbundling. Number of unbundling loops (full and shared) 75 803 (end of<br />

June 30 2010).<br />

b) As elements of duct, dark fibre access, local loop unbundling and terminating segment<br />

access. Specific product details will include the Reference offer.<br />

c) Currently included in part in Wholesale unbundled access (including shared access) to<br />

metallic loops and sub-loops, for the purpose of providing broadband and voice services<br />

market. Planned as one of Market 4 measures.<br />

d) Proposed Market 4 remedies:<br />

� Reference offer (release date: 3 months after the SMP decision is issued).<br />

� Access obligation.<br />

� Transparency obligation –- information on geographical location, network architecture,<br />

available capacity and other physical characteristics of civil engineering infrastructure;<br />

publication of Key Performance Indicators.<br />

� Non-discrimination obligations – inert alia: to offer identical terms and conditions in<br />

comparable circumstances; to prevent the exchange of unauthorized information<br />

between employees of the wholesale and retail part of SMP operator, ignoring safety<br />

rules; to apply IT systems for ordering telecommunication access to ensure equal<br />

access to information for all entities, and preventing discriminatory flow of<br />

unauthorized information.<br />

e) Costs determined based on cost model (Art. 13 of AD).<br />

f) Price control obligation – Art. 13 of AD (charges based on costs incurred).<br />

g) Not applicable.<br />

3.3 Cabinet unbundling<br />

a. Available on a mandated basis (current SMP decision: Wholesale unbundled access<br />

(including shared access) to metallic loops and sub-loops, for the purpose of providing<br />

broadband and voice services market; planned SMP Market 4 decision). Number of the<br />
