3.1 Access to in-house wiring or equivalent<br />

In-house wiring access products are available on a mandatory basis. However, the roll-out is<br />

still in early stages and access products are getting increasingly available. As of 30th June<br />

2010, 83 000 households (out of 910 000 FttH household) were eligible for in-house wiring<br />

access products.<br />

a) In-house wiring access products are passive access products and may either be :<br />

� paid one-shot in the form of an IRU for a long period (often exceeding 60 years) given<br />

by the operator of the building. This product is available on a commune per commune<br />

basis and may include a risk premium,;<br />

� building per building access offers (available from France Télécom, SFR and Free) as<br />

a long-term lease, either paid as a one-off fee or paid monthly.<br />

The access point can be situated within the limits of private property in the case of<br />

existing buildings in very high-density areas that have at least 12 residential or office<br />

units, or which are connected to a visitable public sewage network through a supply<br />

tunnel which is also visitable. In all the other cases, the access point will be located<br />

outside the limits of private property.<br />

b) Access to in-house wiring is mandated though symmetrical regulation (based on French<br />

national law).<br />

c) Included in relevant Market 4 definition (no obligation associated yet).<br />

d) Current regulatory obligations are based on the decision n°09-<strong>11</strong>06. The decision already<br />

provides obligations applicable throughout the territory:<br />

� Access at the concentration point has to be provided via a passive offer : according to<br />

the decision, the building operator has to offer access to a passive concentration<br />

point; notwithstanding when at least four fibre per dwelling unit have been installed<br />

and have been bought by operators, access may only be offered at a point further up<br />

in the network, via a passive or an active offer.<br />

� The building operator has to publish an access offer, specifying the conditions of<br />

access to lines with either a dedicated optical fibre or a shared fibre line and access to<br />

specific resources.<br />

� The building operator has to transmit prior information on buildings it has equipped<br />

with fibre optic lines and on concentration points.<br />
