6 Symmetrical regulation based on national legislation<br />

<strong>BoR</strong> (<strong>11</strong>) <strong>06b</strong><br />

� E.g. laws in France, Portugal, Spain: elaborate e.g. on the scope and content of the<br />

national legislation applied and also on which entities are covered by this legislation (see<br />

ERG (09) 17 Section D5).<br />

Symmetrical provisions for infrastructure sharing and construction of the electronic<br />

communications networks are established in the Law of Electronic communications and<br />

further elaborated in the secondary legislation. 1) Under the established framework all the<br />

constructions of the ECN should be performed in accordance with the provisions of the<br />

secondary legislation which prescribes in details requirements for the construction of ECN<br />

e.g. the diameters of the ducts to be laid in particular circumstances, the size of the inhouse<br />

cabinets, horizontal/vertical cabling etc. 2) Established framework as well obliges all<br />

the persons owning the infrastructure which could be used for the construction of the ECN<br />

under the certain conditions provide the access to such infrastructure for common use. In<br />

2Q 2010 RRT complemented infrastructure sharing framework with the methodology for<br />

the calculation of the free space in the duct.<br />

7 National next generation broadband initiatives/ measures<br />

� Illustrate the main content of initiatives/measures aiming at promoting next generation<br />

broadband. 7 Consider the following aspects:<br />

In 2010 preparation of the National Broadband strategy was launched. It is planned to<br />

incorporate measures dedicated to simplification of the infrastructure construction and<br />

coordination of civil works. Rural areas: In 2009 II phase of the RAIN (Rural Area<br />

Information Technology Network) project was decided by the EC as not raising objections<br />

as the State aid contained therein is compatible with Article 87(3)(c) of the EC Treaty by<br />

the EC. The overall objective of RAIN: to develop an infrastructure of electronic networks<br />

offering wholesale broadband services in rural areas of Lithuania, which are currently not<br />

served and where there are no plans for coverage in the near future. During the II phase of<br />

the project the broadband network coverage will be extended from the current 80% to<br />

approximately 98% of the Lithuanian population. RAIN-2 construction works officially<br />

started in 2Q 2010. Urban areas: Some symmetrical measures taken (See sheet Nr. 6).<br />

- Main focus of the initiative/measure (e.g. providing broadband in currently underserved<br />

areas; outlining the regulatory approach towards <strong>NGA</strong>s networks in order to provide<br />

legal certainty and planning security for operators; providing transparency );<br />
