To take account of data protection, infrastructure operators can classify data as sensitive.<br />

In this case, BNetzA will submit requests to the infrastructure operators who will then<br />

decide whether/to what extent BNetzA may pass on these data.<br />

- How are business secrets dealt with?<br />

BNetzA ensures that unauthorised parties cannot access the data.<br />

- If relevant, elaborate on practical experiences in your country with such databases.<br />

Did this tool contribute to a more efficient provision of broadband services, in particular<br />

in “white” areas? Did any practical problems occur when establishing/running the<br />

database? (Note: this information may be helpful for other NRAs when setting up<br />

similar databases)<br />

At present, it is too early to make such an assessment.<br />

- What are the set-up and running costs of the database, and who pays for them? Were<br />

the costs shared out based on agreements or formal obligations?<br />

Not yet possible to answer this question.<br />

6 Symmetrical regulation based on national legislation<br />

� E.g. laws in France, Portugal, Spain: elaborate e.g. on the scope and content of the<br />

national legislation applied and also on which entities are covered by this legislation (see<br />

ERG (09) 17 Section D5).<br />

No symmetrical regulation based on national legislation in Germany.<br />

7 National next generation broadband initiatives/ measures<br />

� Illustrate the main content of initiatives/measures aiming at promoting next generation<br />

broadband. 8 Consider the following aspects:<br />

- Main focus of the initiative/measure (e.g. providing broadband in currently underserved<br />

areas; outlining the regulatory approach towards <strong>NGA</strong>s networks in order to provide<br />

legal certainty and planning security for operators; providing transparency );<br />
