<strong>The</strong> investigation will involve interviews with the complainant, respondent,<br />
and witnesses and the collection of non-testimonial information and/or<br />
materials, such as emails, text messages, security camera footage, and the<br />
like. Witnesses and information and/or materials may be identified and/or<br />
submitted by the parties or independently gathered by the TIX Investigator.<br />
Both parties will have equal opportunity to present witnesses, including<br />
both fact and expert witnesses, together with other inculpatory and<br />
exculpatory evidence. <strong>The</strong> TIX Investigator may decline to interview<br />
witnesses or collect information that the TIX Investigator deems irrelevant.<br />
<strong>The</strong> scope of the investigation shall be at the discretion of the TIX<br />
Investigator.<br />
Before completion of the investigative report, the TIX Investigator will<br />
send to each party and the party’s advisor the evidence collected for<br />
review in an electronic format or a hard copy, and the parties shall have<br />
ten (10) days to submit a written response to the TIX Investigator, which<br />
the TIX Investigator will consider before completion of the investigative<br />
report. Throughout the investigation, the parties will have those rights<br />
specified in Section 4.4 of this policy.<br />
<strong>The</strong> TIX Investigator will complete the investigation report. Before any<br />
hearing, the TIX Investigator will submit the investigation report and any<br />
appended information to the Title IX Coordinator, or a designee, for review.<br />
At least ten (10) business days before the hearing, the Title IX Investigator,<br />
or a designee, shall send to each party, the party’s advisor, and the<br />
University administrator the investigative report in an electronic format or a<br />
hard copy for their review.<br />
5.5.3 Hearing Committee<br />
Complaints are assigned to committees for adjudication based on the<br />
relationship of the respondent to the University.<br />
5.5.3.1 University Disciplinary Committee<br />
<strong>The</strong> University Disciplinary Committee (UDC) shall adjudicate<br />
complaints proceeding to a hearing against any University student,<br />
including graduate students and College of Medicine students. <strong>The</strong><br />
UDC consists of two to five students and two to four faculty or<br />
staff/administrators and is chaired by a designee of the Dean of<br />
Students. <strong>The</strong> Student Conduct Administrator (SCA) will preside<br />
