notified of the determination on appeal, or (ii) the time to file<br />

an appeal has passed with neither party appealing.<br />

<strong>The</strong> decision of the Vice President for Medical Affairs, Dean of<br />

the College of Medicine, is final.<br />

5.5.7.2.2 Faculty with the University – General Division.<br />

Appeals from complaints against such faculty must be directed<br />

to the Provost. Within three (3) business days of receiving a<br />

valid appeal, the Provost, or a designee, will provide a copy of<br />

the written statement of appeal to the other party. <strong>The</strong>reafter,<br />

the party so notified will have five (5) business days to submit<br />

a written response to the appeal. <strong>The</strong> Provost, or a designee,<br />

shall deliver simultaneous written notification of the outcome<br />

of the appeal and the rationale for the result to the parties<br />

within ten (10) business days after the deadline for submission<br />

of any written response to the appeal. <strong>The</strong> written<br />

determination becomes final upon the earlier of when: (i) the<br />

parties are notified of the determination on appeal, or (ii) the<br />

time to file an appeal has passed with neither party appealing.<br />

<strong>The</strong> decision of the Provost is final.<br />

5.5.7.3 Appeals from Complaints Against Administrators,<br />

Non-Faculty Employees, Contractors, and Third Parties<br />

Appeals from complaints against administrators, non-faculty<br />

employees, contractors, and third parties must be directed to the Vice<br />

President for Finance and Administration. Upon receipt, the Vice<br />

President for Finance and Administration shall notify the President,<br />

who will constitute the Sexual Misconduct Appeals Committee within<br />

three (3) business days of his receipt of the notice. <strong>The</strong> Sexual<br />

Misconduct Appeals Committee shall be a three-member panel<br />

designated by the President for the specific case appealed. No member<br />
