Consent to engage in sexual intercourse, sodomy, sexual acts, or sexual<br />
contact may be communicated by words or actions. <strong>The</strong> existence of a<br />
current or previous marital, dating, social, or sexual relationship with the<br />
defendant is not sufficient to constitute consent. Evidence that the victim<br />
suggested, requested, or otherwise communicated to the defendant that the<br />
defendant use a condom or other birth control device or sexually<br />
transmitted disease protection, without additional evidence of consent, is<br />
not sufficient to constitute consent.<br />
7.3 Campus SaVE Act<br />
<strong>The</strong> Campus Sexual Violence Elimination Act, or Campus SaVE Act, is a<br />
federal law that promises prompt and effective responses by higher education<br />
institutions to incidents of sexual violence. At its core, the Campus SaVE Act<br />
increases transparency about incidents of sexual violence, guarantees<br />
complainants’ rights, sets standards for campus disciplinary proceedings, and<br />
requires campus-wide prevention education programs.<br />
To understand the Campus SaVE Act, it’s important to first know a little about<br />
laws and the judicial process. Every state in the United States has laws against<br />
sexual assault, domestic violence, dating violence, and stalking. To find out<br />
what the sexual violence laws are in the state where you attend college, check<br />
out womenslaw.org.<br />
Additionally, all colleges and universities have a judicial process for sexual<br />
misconduct that functions independently from state laws. While laws and<br />
judicial processes vary by state, by school, and by crime, the Campus SaVE Act,<br />
enforced as of March 2014, represents improvements to the handling of sexual<br />
misconduct on every U.S. college and university campus.<br />
