e. Domestic Violence: Domestic violence is a felony or misdemeanor<br />
crime of violence committed by a current or former spouse, parent, stepparent,<br />
child, step-child, a person with whom the complainant shares a child, a<br />
present household member, or a person who has or had a dating relationship<br />
with the complainant.<br />
Alabama law prohibits domestic violence, pursuant to Alabama Code<br />
§13A-6-130 through 143. Domestic violence does not depend on the gender,<br />
gender identity, gender expression, or sexual orientation of the alleged victim and<br />
the alleged perpetrator. Thus, domestic violence can occur between persons who<br />
consider themselves to be of the same gender/gender identity or a different<br />
gender/gender identity.<br />
Domestic violence is a crime and is prohibited by this policy, no matter the<br />
motivation. Reports of domestic violence, dating violence, stalking, and<br />
electronic stalking will be addressed pursuant to the Complaint Resolution<br />
Procedures.<br />
f. Electronic Stalking: Electronic Stalking occurs when a person, without<br />
the consent of the owner or except as otherwise authorized by law, places any<br />
electronic tracking device on the property of another person, with or without the<br />
intent to surveil or for any other unlawful purpose. Alabama law prohibits<br />
electronic stalking pursuant to Alabama Code §13A-6-95 through § 13A-6-96,<br />
inclusive.<br />
g. Faculty: <strong>The</strong> term “faculty” includes full-time and part-time (i.e., those<br />
without a full-time staff appointment) University employees who teach or carry<br />
out research, including adjunct and clinical faculty, graduate teaching assistants,<br />
graduate research assistants, and administrators with faculty status.<br />
h. Formal Complaint: A formal complaint is a document filed by a<br />
Complainant or signed by the Title IX Coordinator alleging sexual misconduct<br />
against a Respondent and requesting that the University investigate the allegation<br />
of sexual misconduct in accordance with this policy and related procedures. At<br />
the time of filing a Formal Complaint, a Complainant must be participating in or<br />
attempting to participate in the University’s education programs and activities. A<br />
“document filed by the Complainant” means a document or electronic<br />
submission (such as an email) that contains the Complainant’s physical or<br />
electronic signature or otherwise indicates that the Complainant is the person<br />
filing the Formal Complaint.<br />
i. Good Faith Reports: <strong>The</strong> University encourages the good faith<br />
reporting of sexual misconduct. However, the University will not allow this<br />
