<strong>The</strong> adjudicating committee may determine that a violation of this policy<br />

did not occur (or was not proven to the required evidentiary standard) but<br />

that the behavior that occurred was unacceptable in the employment<br />

context. If the adjudicating committee makes such a finding, the respondent<br />

shall be referred to as set forth below for proceedings or additional action as<br />

warranted by this or any other University policy, which may result in<br />

remediation or disciplinary action up to and including termination.<br />

5.5.8.1 Violations by Faculty with USA Health.<br />

Any referrals of faculty with USA Health under Section 5.5.8 shall be<br />

directed to the Office of Academic Affairs for a determination<br />

regarding the discipline of the respondent. <strong>The</strong> University will provide<br />

written notification to the parties of the outcome of any matter referred<br />

to the Office of Academic Affairs, but the complainant will only be<br />

notified of sanctions that directly relate to the complainant. <strong>The</strong><br />

University shall separately notify the complainant, in writing, of any<br />

non-disciplinary remedial measures that will be offered for the<br />

complainant’s benefit. Unless specifically required by law, neither the<br />

complainant, respondent, nor any witness will be allowed to review or<br />

appeal the Office of Academic Affairs’ written determination.<br />

5.5.8.2 Violations by Administrators or Non-Faculty<br />

Employees.<br />

Any referrals of administrators or non-faculty employees under<br />

Section 5.5.8 shall be directed to the Associate VP, Finance &<br />

Administration/CHRO for General Division Employees (Campus) and<br />

to the USA Health Chief Human Resources Officer for USA Health<br />

Employees. <strong>The</strong> (CHRO) will decide regarding discipline of the<br />

respondent and any necessary remedial steps to be taken for the<br />

complainant. <strong>The</strong> (CHRO) will provide written notification to the<br />

parties of the outcome of any matter referred to the (CHRO), but the<br />

complainant will only be notified of sanctions that directly relate to<br />

the complainant. <strong>The</strong> (CHRO) shall separately notify the complainant,<br />
