3. Definitions<br />

• Aiding and abetting – incite, assist, or encourage in the violation of University policy.<br />

• Alleged victim - any individual who may have suffered any harm, loss, or threat due to<br />

a violation(s) of the Code of Student Conduct by a currently enrolled USA student or<br />

RSO.<br />

• Complainant - any individual who brings forth information indicating that a currently<br />

enrolled USA student or RSO may have violated the Code of Student Conduct.<br />

• Disorderly conduct - occurs when an individual or organizations acts with intent to<br />

cause public inconvenience, annoyance, or alarm or recklessly creates a risk thereof.<br />

• Distribution - giving, selling, or exchanging.<br />

• Drug paraphernalia - all equipment, products, and materials used, intended for use,<br />

or designed for use in injecting, ingesting, inhaling, or otherwise introducing into the<br />

human body a controlled substance or illegal drug.<br />

• Faculty - any person appointed or employed by the University to conduct classroom,<br />

clinical, or laboratory activities.<br />

• Hazing - definition under t.<br />

• Indecent conduct - intentional exposure of the genitals, buttocks, or female breasts or<br />

committing or attempting to engage in a sexual act in public, where the individual or<br />

individuals have reason to believe they will and can be observed.<br />

• Intentionally - conscious objective to engage in the described activities.<br />

• Recklessly - conduct that could reasonably be expected to create a substantial risk of<br />

harm to a person(s).<br />

• Registered Student Organization (RSO) - a group of people who work together in an<br />

organized way for a shared purpose and have complied with the University requirements<br />

for registration of a recognized student organization.<br />

• Respondent - any currently enrolled USA student or RSO alleged to be in violation of<br />

the Code of Student Conduct.<br />

• Staff - any person who is not a faculty member that is appointed or employed by the<br />

University to carry out a job or function.<br />

• Students - Any person taking courses at USA, either full-time or part-time, or pursuing<br />

undergraduate, graduate, or professional/extension studies. A person who is not<br />

officially enrolled for a particular term, but who has a continuing relationship with<br />

the University, is considered a “student.” This includes persons newly admitted to<br />

USA, those who are on semester break, and those who are sitting out one or more<br />

semesters.<br />
