‘Homicide’ is a legal label used to gather informa-<br />

ti<strong>on</strong> about a specific way in which people die. Most<br />

generally, homicide can be defined as unlawful<br />

death inflicted <strong>on</strong> a pers<strong>on</strong> by another pers<strong>on</strong>.<br />

Such a broad definiti<strong>on</strong> encompasses a wide<br />

range <str<strong>on</strong>g>of</str<strong>on</strong>g> acts that may result in death and a whole<br />

spectrum <str<strong>on</strong>g>of</str<strong>on</strong>g> states <str<strong>on</strong>g>of</str<strong>on</strong>g> mind <str<strong>on</strong>g>of</str<strong>on</strong>g> the perpetrator.<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> focus <str<strong>on</strong>g>of</str<strong>on</strong>g> this chapter is intenti<strong>on</strong>al homicide,<br />

or murder. Intenti<strong>on</strong>al homicide requires that the<br />

perpetrator purposefully intends to cause the<br />

death or serious injury <str<strong>on</strong>g>of</str<strong>on</strong>g> a victim. Situati<strong>on</strong>s<br />

where the perpetrator is reckless or grossly negli-<br />

gent, or where the perpetrator kills in self-defence,<br />

are therefore usually excluded from the category<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> intenti<strong>on</strong>al homicide. <str<strong>on</strong>g>The</str<strong>on</strong>g> fact that a pers<strong>on</strong> is<br />

intenti<strong>on</strong>ally killed by another does not neces-<br />

sarily mean that the act is a homicide in law. <str<strong>on</strong>g>The</str<strong>on</strong>g><br />

killing <str<strong>on</strong>g>of</str<strong>on</strong>g> a pers<strong>on</strong> by a police <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer acting legiti-<br />

mately in the line <str<strong>on</strong>g>of</str<strong>on</strong>g> duty is an obvious exclusi<strong>on</strong>,<br />

as is the killing <str<strong>on</strong>g>of</str<strong>on</strong>g> an enemy combatant during a<br />

war or armed c<strong>on</strong>flict.<br />

Despite varying definiti<strong>on</strong>s, ‘homicide’ is the most<br />

widely collected data source <strong>on</strong> n<strong>on</strong>-c<strong>on</strong>flict-<br />

related armed violence across and within coun-<br />

tries. <str<strong>on</strong>g>The</str<strong>on</strong>g> killing <str<strong>on</strong>g>of</str<strong>on</strong>g> a pers<strong>on</strong> is <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> the most<br />

serious crimes and therefore tends to be recorded<br />

more effectively than other crimes. <str<strong>on</strong>g>The</str<strong>on</strong>g> fact <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />

dead body is usually processed by the medical<br />

or public health system, in additi<strong>on</strong> to the police<br />

and criminal justice system, creating two potential<br />

sources <str<strong>on</strong>g>of</str<strong>on</strong>g> administrative statistics. In additi<strong>on</strong><br />

to counting direct and indirect deaths from armed<br />

c<strong>on</strong>flict, numbers and rates <str<strong>on</strong>g>of</str<strong>on</strong>g> homicides are use-<br />

ful indicators to capture the n<strong>on</strong>-c<strong>on</strong>flict-related<br />

burden <str<strong>on</strong>g>of</str<strong>on</strong>g> armed violence.<br />

<str<strong>on</strong>g>Armed</str<strong>on</strong>g> violence also results in many tens <str<strong>on</strong>g>of</str<strong>on</strong>g> thou-<br />

sands more victims than the 490,000 homicide<br />

victims in 2004. <str<strong>on</strong>g>The</str<strong>on</strong>g>re are, however, no reliable<br />

estimates for the number <str<strong>on</strong>g>of</str<strong>on</strong>g> people who are injured<br />

(with either minor injuries or permanent disabili-<br />

ties), or who become victims <str<strong>on</strong>g>of</str<strong>on</strong>g> armed crimes<br />

such as robbery, carjacking, or armed assault.<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> legal label ‘homicide’ captures a wide range<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> acts, including domestic disputes that end in<br />

a killing; interpers<strong>on</strong>al violence; violent c<strong>on</strong>flicts<br />

over land, resources, grazing, or water rights;<br />

inter-gang clashes over turf or c<strong>on</strong>trol; and pred-<br />

atory violence and killing by armed groups. For<br />

example, most <str<strong>on</strong>g>of</str<strong>on</strong>g> the deaths in Kenya in the after-<br />

math <str<strong>on</strong>g>of</str<strong>on</strong>g> the disputed 2007 electi<strong>on</strong> would be<br />

c<strong>on</strong>sidered intenti<strong>on</strong>al homicide, as would the<br />

more than 2,500 pers<strong>on</strong>s killed in drug-related
