Court of Honor The term “infringement of fair business practices” refers to the infringement of customs
established in trading goods and providing services as fair business practices, as provided by the Obligations
Act and the Trade Act. Fair business practices lead to the emergence of business rules, a systematized collection
of customs expected to be followed by all or some business entities (depending on the profession). The
importance of establishing an infringement of fair business practices lies in the fact that disciplinary measures
contribute to the development of perpetrators’ personal ethics and business ethics in general.
Since Croatia is getting closer to the EU, the sanctions for infringement of fair business activities become
all the more important, because of the EU consumer protection regulations. The CCE Court of Honor was established
not only to punish, but also to try to reconcile the parties and settle their disputes to their mutual satisfaction.
The Court also educates and warns the members if their conduct toward consumers is not in accordance
with fair business practices. It is also active in the process of harmonization with the standards applying
in legal operations.
Since the protection of rights and interests in regular courts involves costly and time-consuming proceedings,
the CCE Court of Honor is of great significance, its services being quick and free of charge. It takes a load
off the regular courts and intends to further strengthen its influence among members, respect the measures
imposed against the infringement of social discipline and cooperate with consumer protection associations. The
organization and work are stipulated by the Working Rules of the Court of Honor at the CCE (NN 64/2001) and
other general acts of the CCE. Since the end of the Homeland War the number of cases filed with the Court of
Honor has been continually increasing, making it more and more important in regulating the conduct of business
entities. The judges for the panels of first and second instance are elected among eminent business people,
lawyers, economists and other experts whose good knowledge of fair business practices and business conduct
contributes to identifying and sanctioning the infringements. The main purpose of the Court of Honor,
