May it Please Your Honor and you Gentlemen<br />

FOR the Prosecution:<br />

are approaching the close of this momen-<br />

WEtous hearing, and as I address myself to<br />

your Honor, I have a feeling of humility and un-<br />

worthiness.<br />

Mr. <strong>Darrow</strong> has talked at length on the one sub-<br />

ject, if your Honor please, that has troubled us here,<br />

that is a subject of discussion throughout the entire<br />

world: What shall the punishment be? Shall it be<br />

death, or life imprisonment?<br />

And, if your Honor please, on the subject of pun-<br />

ishment, the subject that possesses your Honor's<br />

entire interest, you have been listening to a master.<br />

He has told you, from his reading and study, of the<br />

growth and development of the ideas of punishment,<br />

from the ancient and barbarous past. Your Honor<br />

remembers his speaking of a <strong>case</strong> in which they<br />

burned a girl thirteen years of age. Here are six<br />

lines from Lawyers' Reports Annotated, mentioning<br />

this <strong>case</strong>. I read from page 200:<br />

DeWalborough, who Hale tells us (i Hale, Pleas, <strong>The</strong><br />
