get the money after that boy's body had been found,<br />

they would be taking chances of being caught. So<br />

the plan was given up.<br />

And was it an elaborate plan, your Honor? This<br />

drug store was located about two hundred feet from<br />

the Illinois Central depot on 63 rd Street. It wa^<br />

their intention to have Jacob Franks go to this drug<br />

store; they would make their call there; nobody<br />

knew what instructions he would receive; conse-<br />

quently the police could not be waiting or watching<br />

for them. And, after Jacob Franks received that<br />

call, your Honor, he would have had just sufficient<br />

time when he was told to go to that depot, to get<br />

on that train going to Michigan City, its final des-<br />

tination Boston.<br />

And even then, after receiving the instructions as<br />

to what to do in the drug store, he would not know<br />

what the ultimate plan was going to be. He would<br />

have been told, your Honor, had their plans worked<br />

out, to go to the rear car of this train and to go to<br />

this telegraph blank box; and that there he would<br />

find a letter, and to proceed immediately to the rear<br />

platform, to open the letter and read it.<br />

<strong>The</strong>n what did the letter state? It told Jacob<br />

Franks to turn to the east, and to watch for a large<br />

red brick factory with a black water tower on it,<br />

and the word " Champion " inscribed on the tower;<br />

to have the money ready and as he reached the<br />

south end of the factory described in this letter,<br />

to count five hurriedly, and then throw it.<br />
