was robbing <strong>Leopold</strong>. " In a way, I have always<br />

been sort of afraid of him. He intimidated me by<br />

threatening to expose me, and I could not stand it."<br />

And on page 123: " Of late the patient, <strong>Loeb</strong>, had<br />

often thought of the possibility of shooting his asso-<br />

ciate." He was afraid of <strong>Leopold</strong>, he was afraid<br />

that <strong>Leopold</strong> might tell of A, B, C and D.<br />

And again, on page 123, your Honor: " He often<br />

contemplated shooting his associate when they were<br />

out together and they had the associate's revolvers<br />

along. He thought of pointing the revolver at his<br />

associate and shooting him. He denied ever having<br />

thought of hitting him over the head with a chisel.<br />

' <strong>The</strong> idea of murdering a fellow, especially alone,<br />

I don't think I could have done it. If I could have<br />

snapped my fingers and made him pass away in a<br />

heart attack, I would have done it.' "<br />

Now we can understand why the doctors in their<br />

testimony suppressed this part of the testimony.<br />

Now we can understand what A, B, C and D are.<br />

On page 124: "One reason why he never murdered<br />

" <strong>Leopold</strong> — the report says " associate " —<br />

'' was that he felt that he would be suspected and<br />

there was no very safe way of doing it."<br />

I have demonstrated by their own evidence, your<br />

Honor, that money was the underlying motive of the<br />

whole thing, and that they were not going to kill<br />

anybody if they thought there was a possibility of<br />

being caught. <strong>The</strong>y did not kill the first man they<br />

had in mind because he was a larger man than<br />
