Chapter 7 - Control and supervision over observance of OH&S legislation
Article 34. State control and supervision over observance of OH&S legislation
State control and supervision over observance of OH&S legislation is exercised by the Department
of state inspection of labor of the Ministry of Labor and Social Protection of the Republic of Belarus,
by other specially authorized state bodies of control and supervision within their scope of
competence in relevant spheres of activities.
State control over observance of OH&S legislation is also exercised by the republican bodies of
state administration, by other state organizations subordinate to the Government of the Republic of
Belarus, by local executive and administrative bodies in accordance with the legislation.
Article 35. Prosecutor’s supervision over observance of OH &S at work
Supervision over precise and universal application of the OH&S legislation in practice by republican
bodies of state administration, other state organizations subordinate to the Government of Belarus,
by local executive and administrative bodies of supervision and control, by employers and employed
persons is exercised by Prosecutor General of the Republic of Belarus and by prosecutors
subordinate to him.
Article 36. Department of State Inspection of Labor of the Ministry of Labor and Social
Protection of the Republic of Belarus
The Department of State Inspection of Labor of the Ministry of Labor and Social Protection of the
Republic of Belarus exercises state supervision and control over application of OH&S legislation in
practice by bodies of state administration, other state organizations subordinate to the Government
of the Republic of Belarus and by the employers.
Executive officers of the Department of State Inspection of Labor of the Ministry of Labor and Social
Protection who act as state inspectors of labor have the right to:
o have free access at any time of the day or night on submitting their state adopted permits to
the territory of the organization, facilities and premises of the employer for verifying the
observance of the OH&S legislation at work;
o issue the improvement notes compulsory for implementation by employer to rectify the
disclosed violations of regulatory legal acts as well as technical regulatory legal acts
containing OH&S requirements; perform inspections of industrial buildings, (premises)
technological processes, equipment and other facilities that can produce direct hazard to life
or health of employed persons and other employees;
