o in a legally established manner address state bodies, prosecution offices for taking<br />

measures on disclosed violations as well as for brining to responsibility the persons who<br />

allowed OH&S violation and those who neglected the implementation of the improvement<br />

note issued by the trade union labor inspector;<br />

o exercise other powers envisaged by the legislation.<br />

The improvement notes issued by the trade union labor inspectors shall be subjects for compulsory<br />

implementation by employers.<br />

In an organization the social public control over observance of the OH&S legislation can be<br />

exercised by persons authorized by the employed persons of the organization. The elections of the<br />

authorized persons responsible for OH&S take place at a general meeting (conference) of the<br />

organization and authorized persons are elected for the period from 2 to 5 years. The number of<br />

authorized persons is also determined at the conference. The authorized persons in the sphere of<br />

OH&S exercise social public control over observance of OH&S at work in the order established by<br />

the Government of the Republic of Belarus or by its authorized body.<br />

Article 39. Cooperation and interaction between control and supervisory bodies in the<br />

sphere of OH&S<br />

When exercising state supervision and control over observance of OH&S legislation at work the<br />

Department of state inspection of labor of the Ministry of Labor and Social Protection of the Republic<br />

of Belarus and other specially authorized bodies of supervision and control cooperate between<br />

themselves and with the republican bodies of state administration, other state organizations<br />

subordinate to the Government of the Republic of Belarus, local bodies of executive and<br />

administrative bodies and trade unions.<br />

The main directions of cooperation and interaction between bodies of supervision and control are:<br />

organization and joint running of verifications of status of working conditions and OH&S standards in<br />

the organizations and in private companies, exchange of information on results of the performed<br />

verifications of the observance of OH&S, adoption of common and coordinated decisions and<br />

measures on elimination of violations and observance of the OH&S legislation;<br />

o working out and submitting the proposals concerning preparation and adoption of the<br />

relevant regulatory legal acts as well as technical regulatory legal acts containing OH&S<br />

requirements;<br />

o preparation of proposals to the republican bodies of state administration and other<br />

organizations subordinate to the Government of the Republic of Belarus on identifying the<br />

priorities in scientific and research programs in the sphere of OH&S.<br />
