The occupational health & safety requirements shall be the subject for compulsory implementation<br />
by employers and employed persons as soon as the industrial relations occur between them as well<br />
as in case of engagement of employed persons in performing works (rendering services) as<br />
specified by article 2 of the present Law having no labor relations with employers.<br />
When the occupational health & safety requirements are not mentioned in the regulatory legal acts<br />
and in technical regulatory legal acts too the employers take necessary measures to ensure<br />
preservation of life, health and work ability of employed persons in the course of their work.<br />
Chapter 2 - State Administration in the Sphere of Occupational Health &<br />
Safety<br />
Article 4. State administration in the sphere of occupational health & safety<br />
The state administration in the sphere of occupational health & safety is exercised by the President<br />
of the Republic of Belarus, the Government of the Republic of Belarus, republican bodies of state<br />
administration, other state organizations subordinate to the Government of the Republic of Belarus,<br />
local executive and administrative bodies within the scope of their competence.<br />
Article 5. Authorities (powers) of the President of the Republic of Belarus in the sphere of<br />
occupational health & safety<br />
The President of the Republic of Belarus determines uniform state policy in the sphere of<br />
occupational health & safety and exercises other powers in this sphere in compliance with the<br />
Constitution of the Republic of Belarus, the present Law and other legislation acts.<br />
Article 6. Authorities (powers) of the Government of the Republic of Belarus in the sphere of<br />
occupational health & safety<br />
The Government of the Republic of Belarus ensures the implementation of uniform state policy in<br />
the sphere of occupational health & safety, defines, within the scope of its competence, the<br />
authorities (powers) for the republican bodies of state administration, other bodies subordinate the<br />
Government of the Republic of Belarus in the sphere of occupational health & safety, initiates<br />
working out of target programs of improvement of working conditions and occupational health &<br />
safety standards, exercises other powers in the sphere of occupational health & safety assigned by<br />
the Constitution of the Republic of Belarus, by the Laws of the Republic of Belarus and by the acts<br />
of the President of the Republic of Belarus.<br />
